    Spoke to my boss, he said he needs to speak to someone and he got back to me, that they will sort it out. And I will get refund.

    That is very good news.

    It seems that some small businesses take on staff without doing enough research into what their responsibilities as an employer are.

    I'm definitely not staying.
    My employer has business in different area already for couple of years, I'm sure he knows what rules he should follow.... Couldn't think of him less right now....

    Check your written particulars of employment. You do have something in writing about your entitlement to holidays, sick pay and notice, what your job is (eg a job title) and how you are paid, don't you?

    No I don't, I was basically running away from my previous employer, who was in administration. I wasn't paid on time, and lots of people didn't get paid or didn't get paid full wage. So I run away...into this. And I know it will be a problem get my holiday paid etc...

    I'm assuming you have worked there for less than a year.

    In the absence of written particulars you are entitled to the minimum statutory paid holidays - 5.6 weeks a year. You will have a personal holiday year from the first day of your employment. (He can't hide behind a company holiday year which conveniently for him ends at a point round about now, thus losing your accrued leave because you didn't ask for it.)

    In the absence of written particulars you are entitled to holiday accruing on all your worked time. (He can't say your contracted hours are, for example 5 a week and everything above that is overtime and you don't attract holiday on overtime.)

    I'm sure you are looking for another job, and as long as you leave for a new job before the end of your holiday year, your current employer will have to pay for accrued leave not taken.
