Employer deducting Employer's NIC from my wage

    I've just been told by the accountant that my boss told them they need to charge me for the Employers NIC....
  • What the accountant has told you constitutes and illegal deduction of earnings: a, because it is the employers' liability to HMRC and b, because you have not agreed to a non-statutory deduction of your pay.
    Tell employer that you will contact HMRC for a refund of the employers' national insurance has it is not for the employee to pay and watch what happens in your next pay packet.
    Employer is wrong and the accountant probably knows it but has to do what employer instructs.

    I just can't believe this, to be honest.
    When I asked him this morning that I don't understand it. He said he will find out. Can I ask him to give me a refund or do I have to contact the HMRC? Can I trust him now that he is paying anything to HMRC??

    They have made an illegal deduction to the payroll

    You should get it back the same day ie today

    As long as you have a payslip and get a P60 in May its up to them to pay the HMRC not you at all.

  • I agree that finding another job seems the best thing to do.

    This employer may not know or care about what employers are supposed to do, or he could be deliberately cheating you. Either way, ignoring the rules is no way to run a business.

    Do make it clear that you want your money back and will contact HMRC about the deduction if necessary.
