Anyone have any thoughts on this? I will hold off until we have a consensus!

Did your company write to the PPC to name you as the driver or as the usual keeper? Use the descriptive wording that matches what your company wrote.

I will go with "i am the usual driver" in this case.

Just a quick update. Excel have sent POPLA the supporting evidence relating to my appeal. Is there anything I should be doing at this stage or do I just sit tight?

Have they sent YOU a copy too? (They should do).

Check it over to see if there's anything they are claiming which is obviously incorrect. E.g. it's not unusual for a PPC to submit a signage plan for completely the wrong site.

Hi, yes I have a copy. To my untrained eye it all looks correct and VERY thorough. They have included evidence including pre estimate of loss justifcations, signed agreements with the land owner etc. Is this normal? Everyone is very confident on here that it will be rejected, but I am a little nervous still! I anyone would like to scan over the documents they have provided then I will be happy to share them.

If you search Excel as a keyword on this parking forum you will find other people get that 'evidence' and then Excel lose, because the so-called summary of loss is no such thing. It includes office costs and a write-off allowance and all sorts of drivel. And as we think money just might change hands at this car park between Excel and the Peel Centre (allegedly) the appeal you sent also covers this - how can they claim twice for stuff like signs an ANPR cameras?

Do you have the actual contract - can you see if there is an element of revenue sharing, or payment made - or have they covered up some sections? If they have covered stuff up, email POPLA and tell them you haven't got an unredacted contract in your evidence pack and is that the same pack as the Assessor has at POPLA? If they have only sent a site agreement or witness statement from the Peel Centre, and not the whole contract, email POPLA and tell them you haven't got the contract and, as such, this limited 'evidence pack' doesn't rebut your assertion in your appeal that they do not have a compliant contract. You could also throw into the email that their attempt to (allegedly) massage the figures to form a GPEOL fails, as it includes running costs and other heads of costs which are tax-deductible business expenses which would exist even if no cars breached any t&cs on that day. And some of which you believe the Peel Centre may in fact pay Excel for - which is why you wanted the whole contract in unredacted form as evidence.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well just got my appeal and it's another WIN! Thank you so much to everyone that had helped. What do I do now to help more people fight these crooks?

    Spread the word!

Tell friends, family, colleagues, neighbours. Use social media. Offer to help. You will be surprised how many people you know have quietly paid one of these stupid charges.
