Company car/Excel & Roxburghe

Hi,

I have been sent several "fines" from Excel Parking following a non-payment and now a debt collection agency "Roxburghe" have sent a nice letter demanding £160.00

I have on the advice I have read ignored all of these letters, however the problem is this is a company car and the letters are addressed to the vehicle owner (my company) and not me personally. They are now saying this has to be paid as they dont want a debt collector coming after them.

Can I either reassure them that this wont happen or would I be better contacting Roxburghe/Excel and saying I was the driver for them to chase me?

Is it enforceable if they dont know the driver of the car?

    Where was the parking incident? And where is the company based?

    All based in England. The "offence" was at Peel Centre, Stockport which seems to appear a few times on this thread, and my company is based in Lancashire.
  • You need to get your company (or the lease company if it's leased by your company) to name you as the driver for each ticket. They should do this to Excel - forget Roxburghe. That resets the appeal clock for you, so you can appeal, lose, appeal to POPLA and win. It also absolves your company from all responsibility, as per PoFA 2012. This is all assuming the parking events were after 01/10/2012.

    You're lucky the owner of the car isn't charging you an admin fee for each ticket.

    Well, the Ostrich approach is totally wrong for company car drivers.

    Why? Well simply, the Protection of Freedoms Act in 2012 gave Parking companies the ability to pursue the Registered Keepers of vehicles if they didn't tell them who the driver was. And it gave them 28 days to do this.

    Whoever gave you previous advice is badly informed.

    So now the solicitors and debt companies have a softer target - your company who, as expected, don't want to know. Threaten them with court, they aren't going to waste time and effort going to court. They will pay and get the money back from you.

    Yes, you can huff and puff, but we all know that we don't want a battle with our employers that can escalate.

    So why did your company not contact the PPC when they got the Notice to Owner/Keeper through the post and tell them it was you?

    You had better speak to your company and tell them to please inform the solicitor and debt collectors that you were driving and are dealing with it.

    You then need to tell the PPC it was you and to chase you.

    They may choose not to and pursue the company to court. If I was them, that's what I would do knowing that it was likely that the company would pay up before court and get the money from you.

    So, back to the original advice you got. It stinks and tell whoever you got if from that. (If you got it from a forum, bet it was old threads).
  • Andy get your company to write a letter each to Excel and Roxburghe, naming you as the driver with your address using Daisy's letter post 2 on this thread :

    On the Roxburghe letter add:
    "As (company name) is the registered keeper of the vehicle and has now discharged all legal liability in naming the driver on the day, any further communication from your company will be deemed as harassment and will be reported to the OFT"

    (Roxburghe are currently under investigation by the OFT with a view to revoke their licence to operate)

    This re-sets the clock for the appeals process. When you receive your charge from Excel - appeal liability first to get a POPLA code - do plenty of reading of current threads especially these two:

    In the meantime write to the Peel Centre Manager to get this charge cancelled - again plenty of info on recent threads for help.

    I have trawled the hundreds of posts regarding Peel Centre, but cannot find a contact name for the manager. The website has a generic contact us form only. Should I just write to "The Manager" or try and be more specific?

    And address? (The PPC will need an address to which to send their comic strips ... I mean, charge notices). :)

    The email address (name) is on the 'Successful Complaints about PPCs' sticky thread in post #3. The Peel Centre is mentioned there specifically.

    Also once you get your PCNs in the post, refer to the other sticky I started 'newbies, got a private PCN? Read this now!' which tells you what you need to know to appeal these as driver.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    My employer wrote to Roxburghe, but they have replied saying they will pursue the registered owner (my employer) as they did not respond previously. My boss is now saying he will pay the £160 and claim it back from me.

    Does anyone have any advice please as I do not feel I should be paying anything.
