CPN Challenge for Car Parking Partnership (Liberty Printers)

Hello all.

I'm a new bod on here but not new to forums so I've had a poke around the forum, read loads and also read the excellent up-to-date guide on this site from the man himself called "Fight Private Parking Tickets" (newbies not allowed to paste links):

However, I was wondering if anyone had any other advice to give regarding the way in which I've been addressed by CPP. I'm going to be completely honest here, as I'm not trying to commit fraud or do anyone out of monies which are fairly due.

Basically I parked at a hospital in a "Limited 20 mins only" space as I had made an appointment to see a specialist at short notice due to the fact that we suspected my partner had a miscarriage while we were on holiday.

Unfortunately, after some tests it was discovered that she had. Obviously we were devastated and I was unable to drive as we were so upset so we waited for a while in the hospital waiting area while we both calmed down.

I then remembered that we had parked in the 20 mins only space so we ran out by which time we had been there for about 40mins, when we noticed there was a parking attendant about to put a ticket on my car so I told him we were going and why I was still in that space. He apologised as he said he was sorry and as a result of our circumstances, said he'd cancel the ticket but I needed to go now, which we did.

While I was still upset, I drove a short way up the road where I could park in a bay by the side of the road while we calmed our nerves.

Anyway, about 5 weeks later I receive the CPN from the CPP which I'm so disgusted at and I'll probably give them "a bloody bird", that's two fingers up in English by not paying, and it states the following (abbreviated version):

Vehicle seen in "Drop Off Area" and a "CPN issued for Breach of Contractual Terms" which were "Overstayed the Permitted Time". I admit that there was a very clear sign by the parking bay and I don't dispute that.

BUT: I never received the ticket, nothing was placed on my window screen or handed to me and I have a witness that the attendant let me off without taking any photos or issuing a ticket.

They also state the CPN offered the driver which is me as the RK, 28 days to pay the ticket which included an early discounted settlement fee. As I had NOT been given a CPN, I couldn't have been given any such offers.

It also states that they have photographic evidence which I can see on their website. I went to have a look at this so called evidence and guess what, there's no such photos there, surprise, surprise.

So my questions are:

Do I write directly to them (I can do this via their website) and explain the above circumstances? From what I've read so far, this could be an exercise in futility!!!

Contact the hospital and explain the disgusting way in which this has been handled?

Do nothing and wait for them to send me letter after letter, which I'm happy to post images of me shredding them, regardless of how colourful they get both in appearance and wording?

Or do I use one of the templates from this site to send them an "up yours" letter refuting the charges as unreasonable and disproportional to the amount of revenue which has really been lost plus an admin charge and at £2 per hour parking charges, I'd say that it wouldn't amount to more than £10!

The reason why I decided to post was because I tried searching to see whether anyone else had posted anything about their dealings with the CPP (Liberty) since the change in law but I couldn't find anything. Also, it appears that most people who had letters like mine, actually found the CPNs on their window screens, apart from areas where they use cameras to catch people.

Either way, in my case there was no such ticket or evidence.

I await any kind individuals who are happy to share some advice.

    So very sorry to hear what has happened, I hope you and your wife are coming to terms with your loss.

    In regards to what to do with this company, send an appeal on that you didn't see the signs, there was no grace period given to leave the car park, their pre estimate of loss doesn't reflect what they are demanding, so it a penalty .

    When they reject they should give you a popla code to appeal to them, when you get it come back here for help, we win 100% of the time .

  • Thank you Stroma as its been a very difficult last month for us.

    Unfortunately, you can't miss the signs as when you drive into the bays, there's a notice on a short post which puts it at the drivers height so you see it clearly when you park.

    It also has the main points like waiting time & fine in big bold letters so to be fair, I was warned.

    However, I had every intention of moving it ASAP after dropping my partner off, by moving the car to a pay and display bay but as soon as we went in, the consultant wanted to see us immediately so I had little option but to accompany my partner and obviously we didn't expect such news either.

    Do you have any other suggestions?

    Yes I can imagine it's been a tough month for you, I know what you are going through as the same happened to my wife some time ago, it was one of the worst experiences we ever had.

    With the ticket, don't worry about what you saw or didn't , just give any mitigating circumstances you want to give them, then wait for the rejection. Also go to the hospital trust and make complaints about this harassment, you have enough on your plate without this pathetic scamming g company on your tail.

  • Thanks again, and agree as it is one of the worst experiences a couple can go through.

    So, tomorrow I'll attempt to get hold of the person responsible for the parking arrangements at the hospital, I assume the Head of their Estates Management or similar and lodge a complaint.

    I'll go and have a look at their website now and see if I can get a contact ready for a call tomorrow morning.

    I'll post back the result.

    One thing for sure, I'm not afraid of any red scary looking letters and if they're going to print lies in their CPN letter, then they've picked on the wrong guy here as it was I that stood outside Tooting Broadway Tube Station all those years ago... :beer:

  • I stand corrected as searching for "Car Parking Partnership" didn't help much but I found another thread by searching for just "Partnership" and saw copies of the letters sent and advice you gave.

    Looks like they don't give up easily and as I'm in the London area, perhaps I'll serve a letter of harassment directly on the person in charge at their Croydon Offices in Person as I won't tolerate that!!!

    I'll start counter legal proceedings... :D

    You should also challenge them on the lack of photo evidence on their website site as your main point and suggest they may have the wrong car registration.

    Mmm, now there's a thought! I'd have to know for sure that they're not withholding it for a while.

    However, I can tell you that local councils now take photo's of offender's vehicles with the PCNs clearly shown on the windscreen with the number plate clearly shown to avoid such challenges.

    Do we know in other cases whether it matters if there's photo evidence or not?

    What about the fact that I had neither a ticket or a photo taken?

    Because I arrived at the car before the attendant was able to slap a ticket on my windscreen, the only possible evidence they have is the fact that I was parked in the bay but as there wasn't any charge for its usage, I wouldn't have needed to display any ticket!

    So on that basis, isn't it their word against mine?

    Can anyone elaborate if it's possible to get pursued for payment if I never had a ticket (CPN) slapped on it by the attendant?

    Contact PALS at the hospital and explain the situation. They should be able to intervene on your behalf and get this charge cancelled.

    But don't take your eye off the time limit for appealing - CPP will duck and dive to get your money. So don't assume a charge has been cancelled, even if the hospital say so, until you receive confirmation from CPP themselves.

    If you have to appeal to the CPP, and then to POPLA, it is no big deal. The regulars on here have 100% success rate at POPLA and will guide you through the process.

    I've just got the hospital's PALS number and will ring them in the morning.

    I'll start there first.

    If I challenge the CPP aren't I kind of admitting that I'm acknowledging I was parked there and that I was the driver?

    Isn't that why some say ignore the letters?
