Once the notice to keeper comes through, the registered keeper appeals and refers to 'the driver' in the third person. It doesn't matter if the RK and the driver are one and the same person for these purposes.
And 'ignore' has not been forum advice for months. Forum assisted appeals win at POPLA 100% of the time and that has been the case since about April of this year. It makes no sense to ignore and leave yourself open to the threat of court action for the next 6 years, when you can get the monkey off your back now.I'm a retired employment solicitor. You challenge the letter that has arrived, as the registered keeper, in order to get a POPLA code. We know how to win at POPLA stage. So no, you do not admit who was driving, you call the driver 'the driver'!
As you have the first letter (which is the 'Notice to Keeper') just respond as the KEEPER by way of 'appeal' in a similar way to Stroma's suggestion above:
Dear CPP,
I am the registered keeper of this car and this is my appeal.
The circumstances of the driver parking at the Hospital were that the driver and passenger...{explain a little bit about mitigating circs} and the attendant was aware of this. In fact he told the driver he had cancelled the ticket under the circumstances so I am very angry to now be hounded by a letter, as keeper of the car. I have complained to the Hospital Facilities Manager and PALS about this treatment and lies told to the driver at a very vulnerable time when the car was already being moved. In a Hospital setting in particular, your priority should be to consider the mitigating circumstances of patients and visitors, over and above the profit of your ticketing regime.
If you should reject my challenge, which is also based on the fact that your charge is an unenforceable penalty because it does not represent any genuine pre-estimate of loss, then send me a POPLA code by return.

So sorry to hear of your loss and hope that PALS and the Facilities Manager sort it anyway without you having to bother to appeal to POPLA. But if you do have to, come back for specific POPLA wording as we KNOW how to win that appeal. DO NOT USE MITIGATION FOR POPLA!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you very much for all that. In fact, I'd like to thank all of you equally, especially Coupon-mad, Stroma and Daisy for all the fantastic advice, support and help.
I managed to get through to the hospitals PALS team today and they're going to look into the situation as they seem to agree that this doesn't seem very fair. They said they'd contact me later on in the week.
In the meantime, I'm going to hold off putting a challenge against the CPN until I know the outcome.
Once I have some news, I'll let you know but the advice to contact any companies customer care team in the first instance, appears to be a good move as any reputable company clearly doesn't want their name in mud, especially if there are genuine mitigating circumstances.
I have noted what you guys have said so even if I have the hospital say they've had the CPN cancelled, I shall insist that the CPP put that in writing.

Hi guys.
As promised, here's an update...
Well, it seems as though on this occasion the soft approach prevailed as I had a call from one of the hospital's Estates Managers, the one who's in charge of parking that is as they reviewed the case that the hospital's PALS team put forward and as a result they are in agreement that this was unfair.
They contacted the CPP and have assured me that the CPN has now been cancelled and rang me to confirm that.
I'm glad that common sense prevailed in this case and not only that, a fair and decent outcome has emerged after having taken into consideration the circumstances under which this happened.
In the meantime, I'll wait a few more days before I submit my case/challenge to the CPP, just for peace of mind so at least, I've complied with what's expected and I'll reference the contact at the hospital as advised so that there can be no ambiguity on their part!
All I can say is a huge thanks again to Stroma, Coupon-mad and Daisy for gearing me up for a fight but I'm glad on this occasion, that "the troops" can stand down as this battle appears to be won.
However, unfortunately it looks as though the war between motorists and the CPN companies continues until something fairer is introduced.
