 Tell your insurance you think the other driver is making a fradulent claim.
 Insurance copanies will most likely call it 50/50 fault and the other driver will be forced to claim under their insurance for their damage.0

 Assuming the third party claims, then he will have a fault claim on his record, and if unprotected his ncd will be impacted - none awarded for the current year and 2 years deducted from any he had at the start of the year. They deduct the 2 from a max of 5, irrespective of how many more than 5 he had.
 The cost of the claim won't be too relevant to the premium.
 He can do dummy quotes now online with and without the claim to see what difference it makes to the premiums.0

            I think the point I am trying to make is my son has no problem paying for the damage he caused, but I think its unfair for him to pay for the damage he didn't cause0

            His solution is to leave this to his insurer to resolve. He cannot prevent the third party making an insurance claim.
 After the matter is resolved, he can reimburse the insurer their outlay and get any lost ncd reinstated.
 Why are there no photos of the damage he did cause if the photo posted is damage he did not cause?0
