    VOSA have been contacted and they're willing to reinspect the vehicle. Waiting to get it booked in this week, but at least its something. The dealer hasn't replied to the email sent back to them on Saturday, so I can guess how they're looking to deal with it.

    Trading Standards also contacted, they're happy that its a sales of goods issue, they're calling me back for more information.

    I think the big thing is to remain positive, and honest! A few people have suggested lying about it, but i'd rather be honest and at least sort it out that way. Might take longer, but is less likely to come back and bite me!

    It had a newish MOT? I think thats the route i would have taken. I still think the garage covered themselves because you knew about the damage and yet failed to inspect it properly.

    But should it have passed an MOT. A call to the MOT station may get them contacting the seller to offer your money back, They have far more to lose.

    As I read the original post, the new MOT was issued by the dealer's own (in-house) MOT facility. VOSA will take that very seriously indeed if they decide it shouldn't have passed on reinspection.

    If they do decide the MOT shouldn't have been issued then there's also a virtually cast-iron SOGA case because the car was sold as roadworthy, even if the faults were mentioned.

    To stay within the law (SOGA and the RTA) they would have had to make a specific statement - in any advertisements as well as in person to the buyer - that the car was not in condition to drive on the road until the faults were repaired.

    I may be wrong but I suspect Dafne wouldn't have bought it if they'd done that?

    Spot on Joe. If I'd have known it was anywhere near that bad, along with the other points mentioned, I'd have avoided it like the plague
  • It's going to be close, for the challenge to the MOT.

    VOSA will only recheck the vehicle, within 3 months of the MOT test.
