Rejecting a car purchased from dealer.

    Then you should formally reject it now then, seek some professional legal advice and return the car.

    Maybe right to "rip off Britain" or "Watchdog" with your story for their help....would be good to see the actual car on telly so no other unsuspecting sucker will fall for the same thing.

    Is it as simple as emailing/writing to the dealer? The car is going to be moved at the moment and won't leave getting specialist until I have an idea of what's happening.

    Trade sale - car must be fit for purpose blah blah blah......doubt a warranty company will pay for this as its an existing fault....only real choice is to reject and return the car.

    Contact VOSA on 0300 123 9000 and explain the situation re the recent MOT and the cracks.

    They may be willing to reinspect the vehicle despite the delay because they allow 3 months for corrosion issues to be reported and structural cracking is a similar category of fault, especially for a known model specific problem like this and especially especially for an MOT done "in house" by the seller! If you don't ask you don't get and, if they do agree to re-inspect, then there will be NO charge to you for the inspection regardless of the outcome.

    No doubt the usual supsect/s will be along shortly to tell you how VOSA aren't a consumer support group and aren't interested in resolving consumer problems. To pre-empt them, that misses the point.

    If VOSA are willing to look, and agree that the car shouldn't have passed an MOT at the time it did then you have a VERY strong case for voiding the sale because selling an unroadworthy vehicle is a criminal offence, whether or not it has a current (or even new) MOT.

    It'll only cost a phonecall and a few minutes of your time to see if they'll investigate.

    Similar to self rusting Mercedes from recent history.

    The cost / benefit analysis probably went something like this:

    Does the fault create an immediate or sudden danger (like potential brake failure, for example) that would require statutory recall? No - the fault will show during servicing or by changes in handling before it causes accidents

    Will it affect every car produced? No - it's caused by over-stressing the shell with the extra power so will only affect those cars where that power is regularly used by the drivers.

    If it doesn't show up under warranty, are the probable owners by the time it shows likely to be future customers for new BMWs? Probably not - if the first owner doesn't rag it then it's likely to be in the hands of some boy-racer chav by the time it shows up.

    Conclusion: No recall, repair under warranty if the fault shows up.
