Wrong reg number on ticket from UKPC

    Oh dear Jane - where did you send your appeal? - This could have been sent easily on-line using their appeals page.


    I do hope it wasn't the PO Box address given on their Notice to Keeper as this NOT their address at all - but a rented box at the Royal Mail sorting office.


    I would suggest that you re-submit your appeal on-line with a covering introduction stating the date originally sent.

    Listen it's fine - do you read your answers? No-one told you to send it recorded, and I pointed out their reply was deemed served to you on 2nd December - which meant you just had to get the reply to them by 30th if you go by the BPA's 28 day guideline for them to allow a person to appeal. Relax! All that has happened is that a poxy letter has crossed in the post which they sent too soon. That's not your problem. You don't have to resubmit something you sent over a fortnight ago. Wait.

    Thanks for the help, but I am getting a bit confused now.
    I replied to the debt agency, as suggested on here, with a copy om my original letter to UKPC, pointing out that I had not heard back from them and asking the debt agency to refer back to UKPC.

    I did post my original letter to UKPC as I could not find their appeals website - is that deliberate as well?
    I received this from the debt agency today:-

    Thank you for your recent communication regarding the above Parking Charge Notice (PCN).
    As per the British Parking Association’s (BPA) Code of Practice, Point 22.7, the driver/keeper/hirer was allowed 28 days from the date the PCN was issued to challenge the PCN. The time to challenge the charge has now expired and therefore access to the Independent Appeals Service (POPLA) is no longer available.
    However, in order to resolve this matter, I will offer the following comments as to why this PCN was correctly issued and is still payable in full.
    My findings
    The site in question is subject to terms and conditions, which are stated on signs throughout the area. Those signs state that drivers must clearly display a valid parking permit for the site. They also warn that failure to do so may result in the issue of a PCN.
    On the date in question the vehicle was parked on the site but no valid permit was clearly displayed. This means that the terms and conditions were breached and a PCN was correctly and legitimately issued and placed on the vehicle for notification purposes.
    I can confirm that no appeal was received by our client, UKPC. If this appeal was sent recorded deliver and you have a track and trace number please provide this to us so we can look into the matter further. If no track and trace number is available I'm afraid the charge will remain as it is.
    What you need to do now
    Please pay £125.00 or provide us with a track and trace number by 23rd January 2014. You can pay online or by phone. Go to https://www.debtrecoveryplus.co.uk or phone 0844 561 0965. You can find full details of how to pay on the reverse of the letter(s) sent to you.
    What will happen if you do not pay what you owe
    If you do not pay the full amount by the date shown above, I will pass your case to our legal team, who will consider taking legal action to recover what is due.
    What if you do not agree
    Although any correspondence that does not provide further evidence will be noted and retained, I cannot guarantee that we will reply to it.
    More information
    This parking charge has been issued under the terms of the Protection of Freedoms Act 2012. To comply with that act, we may need to write to you at specified times until the account is settled

    you need to wait for UKPC to contact you about your appeal to them

    if necessary, complain to the BPA by email that you are being chased by DEBT COLLECTORS and have not had a reply to your initial appeal from UKPC , they may ask for copies of letters etc and they should instruct ukpc to cancel or send you a popla code

    either way the BPA will get back to you about it

    the details are in the newbies thread

    in simple terms, there is a walkthrough of the steps involved here and ukpc dont appear to be adhering to the BPA CoP , hence why you complain

    you arent the first and wont be the last !!

    UPDATE
    I have now had a letter from "Zenith collections" which is a trading name of Debt Recover Plus, stating
    without prejudice
    current outstanding amout is £125.00, however prepared to accept £80 to avoid possible necessity and expenxe of legal action!
    Payment must be made within 14 days,.

    As I have yet to receive an answer from UKPC although I tried to contact them in December, intially by post and then by email. Neither of which they replied to, I would be grateful for further advice.

    Make a formal complaint to the BPA and DVLA that UKPC did not supply a POPLA code when you appealed and passed the matter to debt recovery - this is a direct breach of their code of practice. Send a copy of the original appeal which Coupon composed which will also reveal the discrepancy and the flawed initial notice.

    State that in view of this, you suggest that they instruct their member to cancel the parking charge.

    UKPC seem to be having form lately of going straight to debt recovery and bypassing appeals. However, luckily they do not do court.

    Failure to offer ADR absolves the keeper of liability.
    Write discharging keeper liability under POFA 2013 as they have failed to process the appeal and offer ADR.
