Ok thanks. My main question is, is it ok to send if she's not responded to the case

Just escalate the case as soon as you can. You will have to send it back, at your cost, via a tracked means.

But, the seller will get a strike on their dashboard for being such an !!!!! and you can leave feedback to voice your dissatisfaction.

Once you have escalated ring eBay and explain, ask them if they will cover returns postage, they may just,
  • I would offer to return it, once you have received the postage. When I had to open an item not as described case and the sell refused to refund return postage. Ebay refunded me the cost and postage and I got to keep the item. (I did have photo evidence that it wasn't as described and I offered to return it if she covered the return postage.)

Whilst eBay do sometimes offer to pay it isn't a standard.

Refusing to return until you have postage will mean you will lose a case unless the seller pays up.

I was quoting the other poster who said.....

I would offer to return it, once you have received the postage

Which for case purposes is a refusal.

I have just spoken to eBay livechat, they say I shouldn't return it as she should only be communicating through the case

Well if you want to listen to live chat then why ask here. Live chat will tell you anything, everything and nothing. All of it wrong.

I haven't read the whole of the thread as I am on a mobile.

If you haven't escalated, then the case will time out if you sit here waiting....

If you have escalated, Ebay will tell you to return it. If you fail to do so within the time limit you will lose.

Any carp that live chat will have given will be worthless.

I'm asking because no one has answered my question.
I've tried to get my money back , she refused. I've opened a case , she's not responded in the case, but only told me to return it in messages, all written in capitals.
I'm aware live chat aren't perfect but in the absence of anyone telling me it's ok to send it back when she hasn't officially agreed through the case, I don't want to send it back the be told I shouldn't have done, be ayes she's not agreed through the case.

Ebay will only give you your refund once you send it back, tracked so delivery can be checked.

By law they should, but ebay won't enforce it.

You could ask the seller to pay the return postage, or if they say no try asking ebay as sometimes they will give you a postage label. Otherwise the buyer has to pay the cost.

They even refused to send me the original postage back saying " have you never made a mistake"-they responded to me pointing out they'd sent me the wrong item by saying " sorry" no offer of anything
