Cheeky rude seller-update won case

I bid on a craft item who's size was described as 300 gfor example , I needed an item this size for the amount of material it was to cover. The postage was £3 which seemed prob appropriate. When the item arrived it was only 50g and there was a second class stamp on it. I had asked the seller to get proof of postage as she had a few bits of bad feedback.
I contacted her and said the item was the wrong size. She replied have you never made a mistake I've said sorry. I responded I would like a full refund. She said I'll only give you the original price back not the postage , as it was reasonable. I wouldn't have paid £ 3 for postage if I'd known the item was this small

    Open a case. Ebay will tell you to send the item back for a full refund (item cost plus postage). Sadly you will have to pay to return the item. You could contact ebay to try and get a return postage label as the seller is highly unlikely to offer to pay the costs and sometimes ebay will give you a label.

    You can also leave feedback that reflects your experience.

    I've opened a case as suggested, the seller hasn't responded to the case but responded with- thanks for opening a case!
    They then go on to say that they will refund me WHEN THE ITEM IS RETURNED.
    THis hasn't even been broached
    This is a business seller by the way but their account stars are very bad.
    Should I wait for them to respond in the case before I do any more

    As it is a business seller (rather than a private seller) I would have thought they have to cover the postage cost to return the item under the Distance Selling Regulations

    By law they should, but ebay won't enforce it.

    You could ask the seller to pay the return postage, or if they say no try asking ebay as sometimes they will give you a postage label. Otherwise the buyer has to pay the cost.

    Have they replied saying to return the item or not responded at all?

    If they've said you need to return it you need to find out their address and send it back tracked. If they haven't responded at all you need to wait for a response.

    You may be required to pay to return the goods, but you must have been informed of this as part of the pre-contractual information. if the goods are faulty, then under Sale of Goods, the supplier will always bear the cost of returning them.



    I get the feeling that this seller will only refund original payment if they know you can prove delivery.
    If they don't sell in high volume their days could be numbered with bad feedback/stars.

    They've only responded by messages , no address, but to be honest I'd rather communicate thru the case as they are bloody rude.i wondered if I should not return it until she replies to the case officially. I don't have her address

    Yes thy said they won't refund till I return it- in capitals- I've no issue with returning it- she's trying to turn it round to make me the unreasonable one

    Business sellers have their contact address details in the Business Seller Information box in the listing.
