  • Hi all,

Bit of a weird update (and more questions as well - sorry!)

As far as I am aware, the deadline for receiving the NtK was 17th December, so we were waiting with bated breath until that date. The 17th came and went and nothing arrived, so we were surprised but pleased and assumed we could forget the whole crazy situation.

However I've just received a message from one of my colleagues to say that she's only just got round to opening some post and has received a NtK, dated 29/11 and posted 2/12 which puts it right in the middle of the "valid" dates.

It seems as though they have just selected random ones to pursue - is this normal? And if it turns out that we did have one but it didn't get to us because of dodgy post service etc then what happens? It's hard to prove non-receipt of post as they obviously weren't sent recorded delivery etc.

Am I right in thinking it's a "soft" appeal to the parking company now?

Thanks for your time - I wasn't expecting this kind of update...scared because we HAVEN'T received anything!!

you wait for the NTK , simple as that

the ball is in their court, and so are any deadlines too

    posts #3 , #4 , #5 and #12 told you this too

your friend needs to soft appeal it to the PPC and demand a popla code if refused

you do the same if and whan the ntk arrives, but dependent on the date they may be out of time, so check back here first, tell your friend to post their own thread on here too (mentioning this thread within their thread)

Parking Timescales for event where NtK is attached to windscreen
Notice to keeper must be received on or after 28th day after event
Notice to keeper must be received on or before 56th day after event
    Parking event: 22-10-2013
    NtK on or after: 19-11-2013
    NtK on or before: 17-12-2013

So your friend has an NtK in the timescales and should appeal on any grounds, then appeal to POPLA to get this killed off.

As these people seem to be known scammers, you need to defend yourself in case later they say they did post you an NtK which somehow got 'lost' in the post. I would therefore write to the DVLA. foi@dvla.gsi.gov.uk

    Dear DVLA,
My vehicle and the vehicles of two friends each received an NtD on 22-10-2013. One of my friends has now received an NtK, but I have not.

I have reason to believe this operator uses sharp practices and may allege they have posted me an NtK when they have not. Please therefore inform me whether the operator has requested the vehicle keeper address for my vehicle for the above event. If they have, I can then take appropriate action.

Your friend should do the same.

If the DVLA want money for this, come back here for a sterner letter.

Once the DVLA reply, then if you still have not got an NtK, complain to both the DVLA and the BPA.

    Dear DVLA,
Operator x requested my details, but never issued me with an NtK. I therefore believe they had no reasonable case to request my data and I would therefore like to officially complain. If there was reasonable cause, they would have issued an NtK to myself.

If on the other hand you have received an NtK, appeal to the operator and then POPLA.

Seconding hoohoo's advice above. And make sure the colleague knows how to win at POPLA when she gets her rejection letter (and that the colleague knows at this stage to appeal as the keeper only, NOT implying who was driving).
