Cheers Guys
I did say to him last time that this would be my last email.
He is saying the contacted ebay and they agree that he " period of time were i need to be happy with van" and that he will come over to our house at the weekend
Im not replying but I will make sure no-one answers the door at the weekend and will see what happens next
Thanks again for your help0 -
After numerous emails, he now claims he paid £2k cash, which isn't true and yes a receipt on the day as you mentioned would have stopped this argument
Without a receipt, you could claim that he paid £1k cash or 50p cash ... you could say that he left you £50 deposit and owes you the rest ... take your pick!
Seriously though, as suggested - ignore this shyster. He came, inspected with a mechanic (?), negotiated a new price based on the faults disclosed and drove away with what he thought a bargain at the time. He's not happy now - well hopefully he'll get over it.0 -
If there is no paper trial how will your dad convince HMRC how much he sold the van for?0

ebay wont do anything, you may have listed it on ebay, but you did the deal outside of ebay.0 -

ebay is no help because he used private seller
how can it be road worthy if after 5 miles it over heats and wont start again untill it has cooled down
I'd put my money on it, that he's trying every line he can to get some money back off you. As already mentioned eBay won't do anything as it's a car on a private sale.
I had a similar issue a few years back where we sold a boat. The bloke came down with a mate, looked over it, fired it up and told us that he wanted it and paid. A few days later he messaged me saying that he'd taken it for a service and it needed a new engine etc.
He then sent a recorded delivery letter saying he'd spoken to a solicitor etc and they'd recommended x,y and z. I just called his bluff and told him I'd spoken to the CAB who advised that it was a private sale, he'd inspected it and accepted the condition it was in. He told his solicitor who advised him that it was correct and he couldn't chase for any money.0 -
Thanks
I guess the only reason I was a little worried is because i understand the with private buyers it "has to meet the description" and while he figured out there was a problem at time of sale the ebay ad didn't mention it as as far we knew when the ad was live there wasn't an issue
I am sure it will pan out and I appreciate the constructive views0 -
As long as you've got all the emails you'd have a good argument that:
He brought a mechanic to look over it
The car overheated whilst being inspected
you renegotiated the price based on the overheating issue. It's at this point that he should have walked away if he wasn't happy with the over heating issue.
I'm no mechanic and as soon as I saw on the first post that it over heated, I knew the rest of the post was going to tell us the head gasket at gone. So any mechanic who knows one end of a spanner from the other, would know that when inspecting a second hand car, if it's overheating - there's a pretty good chance it can be the headgasket0 -
Thanks

i defininately have all the emails, only after several emails is he now trying to dispute things, with regards to not knowing of overheating and him saying he paid the asking price
Both of which are lies.
I literally know nothing about cars, so I wouldn't even known but he did say his friend was a mechanic lol0
