    "APPEAL RE: PPC Name CHARGE ******/******,*********
    CAR PARK **/**/2013, VEHICLE REG: **** ***

    I am the registered Keeper of the above vehicle and I am appealing against above charge. I contend that I am not liable for the parking charge on the following grounds and would ask that they are all considered.

    As I explained my points in the appeal letter to APCOA i do it here too.



    As i understand the situation,if you park down a car on that bay and if the driver does not have any change,the closest place is the train station for changing money.So the driver have to leave the car and walk away from the car,easily miss the sign on the ground as most of the signs are covered by the end of the long car.

    On the way back the same scenario no visible signs anywhere as some letters on the ground covered.

    You got your tickets purchased from the ticket machine closest to train station in the car park,placing on the dash clearly visible.

    Walk to town,come back later PCN on windscreen.

    Confused driver as ticket still easily visible and still in time.

    PCN says No Valid Permit

    Was not clear that the bay is for Permit holders,there is NO CLEAR SIGNAGE.

    There is NO SIGN on eye level if you parking in that bay.

    Easily missable for any drivers.

    So briefly that would be my appeal to Popla,never done this before,i can accept this is quite a "simple" appeal,dont see the point to using others templates,however if anyone has any idea how to adjust what to put in or take out,just please FEEL FREE to do it.

    You need to chuck that one in the bin (sorry) unless you really want to snatch defeat from the jaws of certain victory.

    Read 'How to win at POPLA' in the 'Newbies read this first!' sticky thread. Big, big difference in the wording of a winning POPLA appeal as you will see. No posters have ever done it before but when they see the examples, the penny drops. We win 100% of POPLA appeals and you can too. The point of using other templates is that those WIN, whereas a description of 'what happened' and 'mitigation' at POPLA, loses.

    Also include that the BPA guidelines say that a discount of 40% should be offered for a discount and their charge is not compliant.

    I am the Registered Keeper of the vehicle related to the parking charge notice received.


    I have researched the matter and would like to point out the following:


    UNCLEAR, INADEQUATE AND NON-COMPLIANT SIGNAGE

    Due to their position, overall size and the barely legible size of the print, the signs in this car park are very hard to read, understand and no notices at all are positioned in to individual bays on eye level.

    I contend that the signs and any core parking terms (PPC) are relying upon were not obvious for any driver to see, read or understand. I request that POPLA check the Operator's evidence and signage map/photos on this point and compare the signs to the BPA Code of Practice requirements. I contend that the signs on this land ( position, clarity) do not comply and fail to properly warn/inform the driver of the terms and any consequences for breach.





    Inappropriate parking charge
    The demand for a payment of £75 as noted within the Parking Charge is a punitive amount that has no relationship to the loss that would have been suffered by the Landowner. The BPA code of practice states:


    If the parking charge that the driver is being asked to pay
    is for a breach of contract or act of trespass, this charge
    must be based on the genuine pre-estimate of loss that
    you suffer.

    If your parking charge is based upon a contractually
    agreed sum, that charge cannot be punitive or
    unreasonable


    Just to make it clear valid ticket purchased and placed on the dash.


    The £75 charge asked for, far exceeds the cost to the landowner who would have charged me £3. for the time my car was parked there. The £72 difference between the parking charge and the parking charge notice cannot be construed as anything but a punitive penalty. In the appeal Apcoa did not address this issue, and has not stated why they feel a £75 charge is an appropriate pre-estimate of loss. For this charge to be justified a full breakdown of the costs Apcoa has suffered as a result of the car being parked at the car park is required and should add up to £75. Normal expenditure the company incurs to carry on their business (e.g. provision of parking, parking enforcement or signage erection) should not be included in the breakdown, as these operational costs would have been suffered irrespective of the car being parked at that car park.


    Prompt payment discount not 40% less


    If prompt payment is made, you must offer a reduced
    payment to reflect your reduced costs in collecting the
    charge. The reduction in cost should be by at least 40% of
    the full charge. ‘Prompt payment’ is defined as 14 days from
    the date the driver or the keeper received the notice.


    The discount that CPP offered for payment within 14 days was £50, 40% off of £75 is £45, a difference to the £50 offered.





    I would contend that this appeal should be allowed for these reasons.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Hi just a few line I have also had a ticket because i/we(4 people) failed to see the "premiere bay" marking on the asphalt.
    It was a courtesy car and I should have just ignore it.
    Instead I wrote to Apcoa saying that I was the driver (do'h)and the appeal has now been rejected.
    Now I only got POPLA to save me.

    Any feedback for appeals to popla because of the premiere bay parking in st albans station?
