Fine for parking on grass verge?

  • The restriction finishes at the end of the double yellow lines, marked by the bar across the end. The Ford and the Vauxhall are beyond the end of the lines, part of the Jaguar is within them.

That what I thought would make sense. But would it win an appeal, can anyone else back this up or disagree here.

the risk of the fee doublin is making me unsure. I dont really know what the law states here

    I already told you above.

And I explained you will most likely win this LATER ON in the 3 stage appeals process, when the discount bribe is long gone.

AND if you simply read the back of the PCN you'd know why there's no risk in sending that first challenge.

I already told you the same. Your car isn't in contravention. The Rover was.

  • Further to advice already given - IMO I would like to raise the following:

From the penalty charge notice supplied the wording of the alleged contravention is-
01 Parked in a restricted street during prescribed hours

Technically speaking none of the cars were parked on street and although the Rover is parked on the grass verge parallel with double yellow line markings - it is not on the pavement and thus not obstructing pedestrians.

Surely the parking restrictions (double yellow lines) only apply to the where tarmac is on the road?

From the pictures it looks as if this strip of grass (wasteland) leads into some sort of field - who owns this stretch of land?

Were there any warning signs stating "DO NOT PARK ON THE GRASS"?

No they don't. As above, they apply the full width of the carriageway including pavement and verge and grass beyond (but I would contend NOT where the Fiesta and Vauxhall were, because they were not adjacent to the DYL).

Thanks CM - I thought they would only apply to road and pavement (grass verge excluded) as I've seen many cars parked on grass verges over the years (with double yellow lines on road) - I guess these were very lucky not to be charged!:)

There are some streets where historically a blind eye is turned by CEOs. There is a street near here like that. Not common though, and in fact this is a contravention by the Rover in the picture above.

They can ticket you for parking on a verge without any lines, however, that requires a different offence code to this and they can not change them once written.
IMO the CEO made an error and could not be bothered looking through his code book as most people pay straight up.
An interesting fact is if everyone who got a ticket in one week made full use of the appeals, it would take an estimated 4 years to hear all the appeals at adjudication for one weeks tickets.
Parking tickets work on the principle of "the wolf never worries about the number of sheep"
    Be happy...;)
  • One other thing. Around the corner from where i parked the road does curves around to the back of the grassy area with double yellow line (this road and the one behind come off a roundabout) Does this changes things as arguably my car could be in front of that (I.e. pavement, grass patch, bushes, grass patch my car)

I wouldn't want to contest things if this makes a difference

As previously advised - you need to head over to pepipoo, as they have more posters with expertise on council tickets.
