I have a collegue that recived a parking fine for parking in the same spot as me (see my black fiesta) but he was unsure on if his back wheels were on the kerb/double yellows. He drove away before thinking to check

Unfortunatly due to car park closuress at my work there is now nowhere to park so I took the risk and parked here today but made sure I was completly on the grass verge. My thinkining being this is a turning point and there is no yellow lines on the grass or durisdiction here for parking.

I took this picture before the fine just in case this happened

thius picture was taken afterward the fine was posted on my window. interestingly the vauxhall next to me didnt get one. The rover got one.

I cant seem to find any guidance on if this is something that they can enforce. Id appreicate advise on if i can challenge it, if its a rock solid claim etc.

That is because the CEO decided that your car and the Rover are in contravention of the double yellows, arguably (certainly the Rover is!).

The Vauxhall isn't. Yours is probably not...I think the CEO was pushing it with your ticket! I would argue it at appeal and take it to adjudication because the Council will reject your first appeal as Councils always do. The PCN (on the back) explains the 3 stages of appeal and you will probably have to go thru them all (no discount in play by then, so decide now if you are up for appealing this properly).

You need to understand that yellow lines apply from property boundary to property boundary, including verges and pavements, across the width of the highway where they are painted. Hence why the Rover is in contravention - you can't avoid DYL by parking on a verge or pavement the other side of the lines.

Hence why I say your car was not in contravention in my view, as you are clearly not to the side of those DYL like the Rover is.

  • the road is mirrored abut the axis of the vauxhall and there are double yellow lines on the other side, does that make a difference.

You can challenge it. Rock solid? Maybe not...but certainly worth the effort.
