    It seems clear that the bank has acted improperly here. They have been defrauded but are trying to make you pay the cost.

    You should phone the FOS helpline for their suggestion on how to pursue this at the moment. They should be able to tell you whether they will take the case now even though it seems that you have not yet completed the formal process at Barclays. Be sure that you mention the panic attack hospitalisation and panic attack to the FOS because that will help you to qualify for their faster process for hardship cases. Also tell them that Barclays has told you on the phone that you can go to the FOS at this point.

    You could try the police but since it's Barclays that is the victim of the fraud here they may not want to accept the report from you.

    Yup. Not a leg to stand on.

    There is no "paid by other means" chargeback for bank transfers. Once you send a Faster Payment it is irrevocable.

    But the FOS will take in to account not just the T&Cs, but also the unfair contracts legislation and, the key point here, fairness to the customer.

    This appears to be a dispute that should never have involved the bank. As such they will lose.

    Ultimately we will wait and see but I suspect Barclays will lose but possibly due to bad handling of the situation rather than necessarily that they were wrong to take the money out the account.

    In my 2 cases where they refused to do chargebacks the FOS advised they were entitled to refuse the request but for the poor handling of the matter they gave awards that exceeded the value of the transactions in question.

    As this is evidently a business we also have to assume that he is operating as a micro business to even be able to use the services of the FOS - though it does sound a fairly safe assumption

    My husband worked very hard to earn money, we were about to move into our own place (we are living in shared accommodation). Barclays have stolen £4500 from him without any kind of explanation or even asking him about the matter.

    They have literally ruined our lives, we have no money now – we have bills to pay, we have had to borrow money from friends. The stress has got to us and I suffered a panic attack over the weekend and had to be hospitalised. I then found out that I am pregnant with our first child, but all this seems to have taken over and we can’t even enjoy what is supposed to be the happiest time of our lives :(

    We have spoken to Barclays on the phone, in branch but they are unwilling to help. They have said we can go to the Ombudsman and take the woman who did this to a Small Claims Court, We will pursue her, I won’t let such a scammer get away with this but it will all take time. On top of that mu husband’s wages will be eaten by Barclays yet again to pay the £800, plus fees.

    I just feel so lost and so badly treated. Surely this is wrong and Barclays should be held responsible. I mean - to take money from someone’s account without any explanation.

    Is there anything we can do? The stress is really making us so unhappy and I fear for the wellbeing on my unborn baby.

    Can someone please help and advise us on what to do?

  • I thought bank transfers could not be reversed in this way, for the very reason that it could be assisting fraud (as appears to be the case here).

    I doubt it. The OP with their 2 posts then silence probably doesn't think it worth making a formal complaint about a completely made-up situation.

    On the assumption its a real story - as per my original post, I have my doubts too

    It's a bit sad that people troll this board, when it's here to help people in genuine trouble.

    What sort of person looks to subvert a resource that provides much-needed support to people who may be experiencing life-changing severe problems?
