You'd purchased the goods, they were yours.
Manager is obviously within his rights to request that you refund them - but that's all he can do. He can't enforce anything.
OP, you chose to refund them. Personally I would have just laughed at his request for a refund.

Being 2 per customer was part of the contract so you broke the terms of that contract. I don't agree that they were legally yours, yes you got away with it to the point of payment but as it was a broken contract the situation was remedied by a refund.
I think it's you who should be appologising for trying to get more than your fair share, your the chancer not them.
To deal directly with OP's question, there is nothing illegal about the manager demanding the goods back. And there would have been nothing illegal about refusing to give them back. OP, you did not have to and anything back. The only point at which anything illegal might have happened would have been if the manager had tried to recover the goods by force.You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -
Nobody forced the OP to have return the goods for a refund, there was no mention of physically prizing the chocolates out of his hands and either forcing him to take a cash refund or taking his wallet to get his card to issue the refund.
It doesn't require the use of physical action for the manager to have been forceful. If they had attempted to intimidate the OP that may have been enough.
OP could have quite easily walked out of the door with the chocolates and the manager wouldn't be able to do a thing about it.
Yes, but as the OP clearly stated that the manager insisted that they returned the goods and as the OP may obviously didn't know their rights at this point, I would say that the manager was using their position to coerce them into doing something that they were not legally required to do.
Although the manager may then have banned OP from ever shopping there again which he is entitled to do.
The press may have said six per customer but it was advertised both in the store and in an email that it was only two per customer.
According to the Op, the e-mail stated 2 per customer per transaction, and they abided by this requirement.
Maybe they were low on stock so wanted to make it fairer and give more customers the chance to buy them.
Without seeing the adverts and e-mail it's impossible to know exactly was stated, but the fact remains, if someone offers payment for goods and that payment is accepted and the goods handed over, those goods belong to the buyer unless a court decides otherwise.0 -
Thank you all for your replies. I do value all your comments and i indeed do understand where some of you say in that I obliged in returning the chocolates.
That said, i was confronted and somewhat taken aback by his actions and authority and indeed did not know my simple rights to rebuke his behaviour. He did not physically force me, but he did leave me with no doubt that there wasn't any other option.
If i had have been thinking more confidently and clearly at the time I would have told him to shove it.
I do not wish to take legal action, although I do feel that the supermarket in question need to admit and apologise for their actions on that day. I'm not making a mountain out of a molehill, i believe 99% of people in my position that day would have had an issue with the way they were treated.
As someone fairly noted - it is the small things that make us tick, a bit like a paper cut i suppose!

As far as I can see, it would be two per customers transaction. Meaning customer could return as a customer and purchase two more.
Unless there was a condition of Two per customer per day\week\month or year, which clearly there was not. The transaction would indicate to me that two items are paid for by a customer on any one visit.
You were within your rights to laugh at the manager and walk out, even at the risk of being banned from the store, I would have by then chosen never to visit again.:A:dance:1+1+1=1:dance::A

I am writing in relation to my recent trip to Morrisons. I have posted the elongated version of events on Facebook and written to them, but they have still provided an unsatisfactory answer.
Scenario - Morrisons have Cadburys Chocolates on offer in the media at 2 for £7, max 6 per customer. I attend the store for an unrelated matter and meet a friend who tells me they are in stock. A manager running round is then saying it is now "2 per customer". Morrisons in their email clearly state it is 2 per customer / transaction.
I purchase my two boxes and leave the store. On speaking with my partner in the car park on the phone she states she would like some, so I go back in to the store and 5 minutes later am at the till with 2 more boxes, as a customer and indeed on a "new" transaction.
I scan the products, pay by card and the transaction is complete. I go to leave the store.
The manager then corners me and demands that i refund the last two boxes that I have purchased as the limit is 2 per customer and he witnessed me come in on two separate occasions. I ask for clarity on the policy as in what is the time limit on the "2 per customer". He cannot answer and just becomes nasty. He demands i go and get a refund and have no choice, so I do that.
My question is:
When you have bought something, completed the sale, the sale is lawful ie. for chocolate not an age limit item, CAN they demand on leaving the store that you return to the counter and process a refund you don't want???? I would have thought there is something illegal about this?
Also, surely their offer of 2 per customer / transaction is open to interpretation???

1. I would have sent my partner in the 2nd time, to get 2 more tins.
