    Pete, it's not really about the chocolates, I don't even eat them, they were for my partner. The principle is about customer service and a legal matter, that is all and it is that query that I came here for HELP for, not stupid criticism!

    No they cannot force you to have a refund.

    They should have refused at the point of sale. They have taken your money, the goods are yours.

    Two big tins of roses for £7 that's a loss leader, no wonder he was prowling, perhaps he was trying to make sure all his regular customers got a look in, rather than eg businesses taking advantage.

    Well legally, once you had paid for the goods then maybe you could have just walked out of the store with them. If you decide to pursue this with formal complaints and requests for an apology or compensation and the threat of legal action (all of which is me making massive assumptions about your intended action) then my opinion is that this would be ridiculous.

    As for getting stupid criticism - it's a hazard of posting on an open forum with a case that some might consider to be making a mountain out of a molehill.

    It is the small things in life that really tick you off, it was me I probably wouldn't be back.

    Being 2 per customer was part of the contract so you broke the terms of that contract. I don't agree that they were legally yours, yes you got away with it to the point of payment but as it was a broken contract the situation was remedied by a refund.

    I think it's you who should be appologising for trying to get more than your fair share, your the chancer not them.
  • If the adverts in the newspapers stated that the offer was limited to 6 per customer and the email that they sent out stated 2 per customer per transaction then it appears to be the manager who is at fault and is the "chancer" and not the op.
    The op offered payment for goods, that payment was accepted and from that point on the goods belonged to them.
    If the manager thought that the contract had been breached then they had the option to seek legal redress. What they didn't have the legal right to do was to force the op to return the goods for a refund.

    Nobody forced the OP to have return the goods for a refund, there was no mention of physically prizing the chocolates out of his hands and either forcing him to take a cash refund or taking his wallet to get his card to issue the refund.

    OP could have quite easily walked out of the door with the chocolates and the manager wouldn't be able to do a thing about it.

    Although the manager may then have banned OP from ever shopping there again which he is entitled to do.

    The press may have said six per customer but it was advertised both in the store and in an email that it was only two per customer. Maybe they were low on stock so wanted to make it fairer and give more customers the chance to buy them.
