    the costs provided do not seem to actually result from the (alledged) breach, so hopefully the same verdict will be given.

    This will not need any more action by you.

    The 'loss' thing will lose it for them, as we've seen that before from VCS, as you have discovered. Also you are the keeper and you are not liable - and you had the point 'not relevant Land under POFA 2012; no registered keeper liability' as belt and braces!

    No worries - but can you pm me the agreement (unless it says the enclosures are strictly confidential?). I would be interested to see it.

    Also I realise they've sent the documents exactly 7 days before the case date.

    Sorry, I can't disclose the PEOL or the agreement as they're marked confidential.

    For the agreement, it's a redacted copy. I know the appeal asks not to accept such a copy, so not sure how that's going to work.

    Aha, well in the 'POPLA decisions' thread, VCS have also lost cases because they have sent a redacted agreement. So they are on a hiding to nothing with your case!

    I have added something to my defense (via email to POPLA)

    In the evidence pack that VCS sent me, is a copy of the agreement.

    BUT 1) it's a redacted copy, and 2) it does not contain schedule 4, which is the fees structure which displays how much commision and profit they are expecting. This is an important point to make when appealing on grounds of NGPEOL.

    So if you've received your evidence pack and the schedule 4 is not included, point it out to the lead assessor as part of your defence.

    Just got an email from POPLA, appeal allowed.

    "The Operator should now cancel the parking charge forthwith."

    Edit: the pdf reader on my mobiel tricked me. On page 2 of the document it clearly shows the reason for allowing the appeal is the GPEOL.
