    So this is round 2...

    I have received a follow up letter.

    It is within the 35 days since I sent my original email.

    It seems to try and address the points I raised.

    The envelope contained:
    1) a letter
    2) a copy of the Parking charge notice
    3) two different A4 printouts of what seems to be the sign on the road before the car stopped, the first one being given as 1000mm x 20000mm, and the second one as 500mm x 660mm
    4) the description of the popla appeal procedure
    5) the popla appeal application for with the pcn number already filled in.

    I'll type in what the letter says exactly...

    I can't see one in the letter, but the prefilled popla form also has the verification code and date at the bottom already filled.

    When a Private Parking Company inevitably turns down your appeal, they are supposed to dish out a 10 digit POPLA code. Here is an explanation as to how the code is derived.

    The code can be broken down into 4 fields:

    PPPDDDYNNN

    PPP is a three digit code identifying the Parking Company. The Pranksters favourite code is 292, which is HighView Parking.

    DDD is the day of the year (001-367) they issued the POPLA code

    Y is the last digit of the year they issued the POPLA code. For 2013, this will be 3

    Here's what the letter says (note that I have corrected some of the English, as there were typos / missing / additional words as if the writer changed their mind mid-sentence when writing)

    We are in receipt of you recent correspondence received on xxxx in connection with the above referenced Parking Charge Notice (PCN).

    We can confirm that DVLA records indicate that you were the Registered Keeper of the above vehicle on the date the contractually agreed Terms and Conditions were breached. The Parking Charge Notice clearly stated that you had 28 days to either appeal, settle the Notice by making payment, or provide a serviceable name and UK address for the driver so that we may pursue them. Despite this request, a full name and serviceable address for the driver has not been provided.

    Please be aware that as you have failed to provide us with the full name and UK serviceable address for the driver within the 28 day period stipulated on the Parking Charge Notice, we are now within our rights to recover from the Registered Keeper under the Protection of Freedoms Act 2012.

    Whilst we understand your concern at receiving a Notice, it is entirely the motorist's responsibility to ensure that they adhere to the Terms and Conditions of use for the airports private access roads. The roadway in question is part of a high security zone and as such motorists are clearly advised not to park, stop or wait on double yellow lines, red routes zones or roadways at any time. Such actions may also pose an obstruction or danger to other road users. There are numerous warning signs in place along the private access roads and we attach a copy of the signs for your reference.
    With reference to the comments made within your correspondence, we would make the following comments:
    We maintain that our signs are clearly visible and meet the requirements set by the British Parking Association (BPA) guidelines. As established members of the BPA, we adhere to their Code of Practice for Private Enforcement on Private Land and Unregulated Car Parks. This Code of Practice gives recommendations in regards to the signage within the private land and car park. The signs within this area fully comply with the recommendations outlined in the Code of Practice and are therefore deemed reasonable.

    Further to your comments with regards to steps to follow and the appeals / challenges procedure, please find enclosed a copy of the Parking Charge Notice which was sent on the xxxx. The reverse of this notice clearly explains every aspect of the appeal / challenge procedure and provides the required and relevant information in accordance with the BPA’s Code of Practice.

    As such we have decided to reject your appeal for the reasons as outlined above.

    The required payment of £60 is to be received within our office by xxxx. If the payment is not received by this date the amount payable will increase to £100. Failure to comply may result in the issue of court proceedings whereby further costs will be incurred.

    Payments can be made online at wwwxxxxx by following the links for “PCN payment”, or over the phone by using a credit or debit card. Alternatively you can pay by cheque or postal order through the post.

    You do have the option to appeal to the “Parking on Private Land Appeals” (POPLA) service, which is an independent body. Details of how to appeal to the POPLA service are attached to this letter in the form of both guidance notes and an appeal form. Please carefully read the guidance notes, particularly those relating to “grounds for appeal”. It is important you note that if you wish to appeal to POPLA, the discount offer will no longer apply and the full charge of £100 will be pursued should your appeal be rejected by POPLA. Further costs may be incurred should it be necessary for us to recover the outstanding charge using debt recovery and/or court action.
    Unfortunately no further appeals will be accepted as all issues raised have been addressed and any queries have been answered. Therefore we must advise that any further appeals or challenges received for this Notice will not be acknowledged or responded to.

    Strange that VCS insist that this road needs to be kept clear for emergency vehicles and security reasons, passing yesterday two men in "Excel" hi-vis vests one in a small "Excel" livered van the other in a gold ford focus happily chatting away parked on the approach road!

    The focus was either his or he was nicking it as he was standing with one foot in leaning on the door. Unfortunately I did not have my camera or phone with me.

    Mind you I now know how they sneak up on people on the nearby industrial estate.
