As G_M says, only a tenant or a court can end a tenancy. Therefore the LL has changed but the tenancy continues under the same conditions as when you signed. It will only change if you sign something new.Don't listen to me, I'm no expert!0 -
LA says that because the money is legally mine they cannot authorise the transfer and so they have to return it to me to then pay new LL.

I have checked on the deposit website with the details i need but it says that they have no record of the deposit BUT when i ring them and give them identical information they can find it and say its protected, is this normal for an automated search on a deposit site to bring back nothing but a human finding it manually ?
Spoke with CAB today and they referred me to specialist housing advice (NHAC i think ?),The CAB rang them on my behalf and CAB rang me back this afternoon to say that they (NHAC) have taken all the details and are going to do some research into if agency fees can be taken from a deposit and get back to me,CAB told me it could be mid-week next week before i hear back from them and to not contact LA until hearing back from them

Dear Mr LA,
If the new landlord is happy for the deposit to be returned, then by all means return it tome, in full.
As for the Payment Plan, that is an unrelated matter and should remain unaltered.

Letter sent to LA today:
"I formally request full repayment of £300 deposit paid to yourself on 19th July 2013 which you deposited with My Deposits.
Regarding the unpaid “Agency fees” and “Deposit protection fee” which you intended to deduct from the £300 deposit this is an unrelated matter and I do not give permission under any circumstances for any money to be deducted from the deposit for this purpose.
I await the repayment within 14 days or at your earliest convenience."

You have to use the correct scheme.
In post 4 you said "I have spoken with the DPS".
Above you state it is with MyDeposits.
I am sure if you get the details correct you should find it on line on the correct scheme website.0 -

Sorry i didnt know there was a deposit company called DPS, i used DPS to mean the deposit scheme LA used,Used the "my deposit" website and it showed no results.0 -

LA has now proposed to carry on the agreement and deduct the next payment from the deposit,we are now looking at getting back £238 rather than £50,small victory i guess as it was never my intention to avoid paying the fees.0 -
Just thought of something else i forgot to ask advice on (dont need to read the rest of the thread to answer this hopefully:
Recieved letter from new LL solicitors dated 3rd October informing change of owners and asking all future rent payments to be made to them from 1st October HOWEVER our TA rent period dates are 18th-17th of following month,to complicate this further our HB payments are paid in arrears on the last Wednesday of the month (next payment is 31st October), this payment covers 1st October to 31st October.
My question is does it get split between old and new LL?
Does the tenancy period supersede the date of new owners taking possession ?0 -
You pay whoever is LL at the time you pay to the best of your knowledge to comply with the contract. The Landlords must deal with the rest between themselves. Not your problem.You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0
