I think any sane judge would say that by not collecting the goods, the OP has failed to mitigate.

If the goods hadn't turned up at the store, that would be a different scenario all together.

That's the problem when being selective with the cut'n'paste tool.
With a bit of fiddling, you can make another comment appear totally different.
