that's the thing, i keep all the emails that were sent to me and that's the last one. I can only assume that the store one wasn't generated or it went into my spam (but the others didn't).

haha, not kicking myself that much, it's only a shirt. It's not a magic shirt spun from fairy dust to bring peace to the world.

I've learnt my lesson about doing the store pick up though.
So why you creating a big stink about it

    It's almost certainly the principle.

So how long is the shop liable for storing the goods? Just move on, leaving it for the best part of a month is taking the mick a little.

6 years. Just like if a shop sends you goods, you reject them, and they refuse to arrange collection.

    What priciples?

it is clear you failed to call and collect the item, so the store returned this to their warehouse and refunded you in full
If you did get an email that as you stated

then this would have given full instruction on where and how to collect it

    1) collect from ___ store before __/__/___
    2) take along this email and the payment card you made the purchase with

because the emails you say you have are not notifications that it was ready, so why say "I got notification emails that it was ready" unless you are not telling us the full story and got the notification email and ignored its instructions.
  • Yup it's a lesson

Thanks for your time guys and gals.

That's irrelevant. This link is about disposing of the goods where the OP has lost the financial value of the product. In the scenario on this thread he got his money back. Which if this link was at all relevant would be covered by the phrase.

"Legally, a trader has a responsibility to take reasonable care of belongings left with them. If they lose or damage your belongings, they must compensate you unless they can show that what happened to them wasn't their fault."

The OP was refunded so compensated.

    It's not relevant anyway!

The goods were neither lost nor damaged, the shop assumed possession of them. It would be equivalent to me taking my car to the garage and them deciding to take ownership of the car and send me some money. Remember the op owned the goods, the contract was complete the moment the goods were dispatched to the shop.

I think the relevant part of that link posted was the following:
IF You Don't Pick Up Your Goods

If you don't pick up your goods left with a trader, they can't dispose of them until they have followed a set procedure.

This includes sending two notices which contain certain information.

I think a Judge would go with what is reasonable to be honest...OP ordered it into a shop for collection for their own convenience and failed to collect in a reasonable time is how I see it.

Not sure if perhaps its just the way you post is structured making it look like you're replying to jreacher1 but...you do realise it wasn't the op that said about principles?

Not to be blunt but you're basically stuffed. You could take them to court and sue for "loss of bargain" ...
But in law, you have to show that you've mitigated your losses.

I think any sane judge would say that by not collecting the goods, the OP has failed to mitigate.

If the goods hadn't turned up at the store, that would be a different scenario all together.
