  • I was wondering if there is any sort of time scale to receive my POPLA code from CEL. I sent a soft appeal to them on 10th October and have heard nothing. No POPLA code , no cancellation ( ha,ha) just silence. Should I just leave it or should I contact them. I don't want to rattle any cages but I don't want to leave myself in a vulnerable situation either. Your advise is very much appreciated.

    They should acknowledge receipt of the appeal within 14 days (if they are going to take longer than that for a decision) and in any case provide a decision within 35 days. But the edges have been blurred on this by ParkingEye pressurising the BPA for a more flexible arrangement.

    I'd rattle their cage by writing and saying that as they have failed to meet BPA Code of Practice requirements you have concluded they have upheld your appeal. Any further communication from them (other than confirmation that the charge is dropped) will be consider harassment on their part and you will take further action against them. You might also want to tell them that your costs are mounting in resolving this issue and you reserve the rights to issue a claim in the Small Claims Court against CEL to recover those costs.

  • Sorry for the delay but I wanted to thank you for taking the time to advise me. I'll get the said letter off to them and hope that it has the desired effect. If they respond with the long awaited POPLA code do I then have to proceed with the POPLA appeal or will it no longer be relevant owing to the time delay.

    If they offer a POPLA code then it's your choice whether to appeal using it or not. (Would be strange to request a POPLA code on appeal rejection and then not use it though - with POPLA you can win and kill the whole thing stone dead).
  • Thank you. Yes, of course, the POPLA code is what I was after and would be more than willing to pursue that route. The reason I was asking was because I was questioning the relevance of it now as they have failed to abide by the BPA Code of Practice by not contacting me and was hoping that it would be the end of the matter. Wishful thinking of course.

    Best bet is to send a POPLA appeal, every time, if you get a POPLA code. Our wording wins.

  • It's now been two weeks since I sent my letter to CEL pointing out that they had broken the BPA Code of Practice by not responding to my earlier request for a POPLA code and my assumption that they have upheld my appeal and therefore the charge had been dropped. I have heard nothing. Complete silence. Where do I go from here? Can I confidently assume that they no longer wish to pursue their request for payment? Is there a time limit for a POPLA code and what would happen if they don't provide one. Does this silence mean that this is the end of this or is that wishful thinking. I just seem to be hitting a brick wall here and just want an end to the whole sorry affair.

    They have 35 days to reply, so this could go on to January, they will not give up the chance to scam
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
