Doesn't have to be, according to the poster called 'lainieee' who asked at her local court (long story v ParkingEye in her case). They said the counter claim could wait.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I received an email from BPA today : "I have received a response from SIP Parking with reference to your complaint. The Parking Charge Notice has been cancelled. They have now amended their process so that they do not pursue these PCNs under POFA unless they are within the 56-day requirement." - so was that the trigger ??
You should be receiving notification of the above shortly.0 -
Excellent news! Had my own court notice from SIP and have been following this and Ed666's threads closely for help and advice. I've also had mine cancelled this week. Just wanted to say a big thanks to everyone who's helped with these cases.0

I wonder how many sanction points the BPA have caned them with?
Let me guess? Ah well, after all, it is Christmas! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Had something similar with mine, almost seems a template response to multiple complaints as my mid-2012 case had nothing to do with POFA. I pushed to check the initial complaint had been fully understood and whether sanction points would be applied...I wonder how many sanction points the BPA have caned them with?

...and this pretty much sums up the BPA's response. SIP have had no sanctions for some very dodgy practice that no doubt intimidated a few folk into paying up.
If anyone gets pre Oct 2012 PCN papers from SIP, send them my way. I may have a couple of emails of use to them
Merry Christmas to all at SIP reading this :beer:0 -
