I suspect that this is what caused them to withdraw as it makes clear that they were suing the wrong person & that the case would get chucked out if they did not withdraw.

1. The Defendant denies he is indebted to the Claimant in any way.

I was not the driver and have a witness statement to support this. SIP have not complied with POFA as described below and cannot pursue me as the keeper. Should I continue to be pursued I will be making an application for costs under section 27.14

I also sent them the same letter twice from different postboxes as provided by Daisy saying they were a vexatious litigant and if they went to court and lost I would show teh judge this letter which claimed £360 for preparing the case for starters ... but why did they take so long ??

Because they didn't want to let go once they thought they had a sniff of money? It must have pained them to discontinue!

Surprised it did take so long though, after Ed666's case was dropped quickly by the same firm.

Well done and Merry Christmas!

Why don't you fire back at them a Personal Costs Notification anyway? ;)

Do it:

http://forums.pepipoo.com/index.php?showtopic=85641

...then when they ignore your Letter before Claim, submit a claim form on MCOL for a cost of about £35 (reclaimable) for your time and costs and damages for distress on top! Vinci and NGP have already paid people in lesser harassment situations than you've been through.

Biker Paul on pepipoo can help you as he's been one to lead the way, as shown in that linked thread.

When you get the paperwork from MCOL and say you're defending there is the option to counterclaim - should this not be when you do it?

They have had a few months of free publicity showing how tough a PPC they are, luckily you and Ed666 stood up to them, some will fold even if they read your successful conclusion, others will just pay it to avoid the whole thing.
If the get 10/20/30 people pay because of this action then they are quids in.
Court action for PPC's is never about recovering money its about proving a point.

Well done on your success!

Update : Notice of discontinuance received today.

Excellent news Cowboy, also had recent notice my own SIP claim has been discontinued. My circumstances were similar to Ed's so I followed his thread rather than creating my own.

Merry Christmas!

Maybe tough is the wrong word. Persistent perhaps, but without the tenacity and attention to detail that will win them cases should they ever set foot in court. At least on current form, anyway.
