Parkingeye county court claim

I used a parking eye car park at my local hospital and entered the first letter of my registration incorrectly as I had not owned the car very long and the reg was similar to my old one. I received letters and ignored them as per the advice in this forum. I have now received a claim form for Northampton county court for £135.00 what should I do now?! Please help :)

  • Thanks, hopefully they have kept records of that day and will see the ticket issued with the slight mistake, it was back in May though :-/

    Regrettably, you are the architect of your own misfortune twofold.

    1. You put the wrong number in.

    2. You used the Ostrich tactic hoping it would go away.

    This is Parking Eye. It doesn't go away with them.

    On the other hand, they are absolutely the PPC with the best track record in cancelling charges when people have made the mistake you did and if you had contacted them explaining the problem, your ticket would almost certainly have been torn up.

    Now, as it stands, they have issued court forms and that has cost them money. I would, therefore, expect them to agree to cancelling the ticket if they get your belated explanation, but I would also expect them to do it on the condition that you reimburse their admin and court costs to date.

    For my part, I think that this would be fair, given the circumstances. You and others may disagree, but that is what I think would be the outcome.

    What advice was that? We have been almost united in advising that you appeal and go through POPLA ever since January/February this year.

    You have been reading old threads, haven't you??? Things changed when POFA came into force a year ago.

    So please don't blame the forum for you reading old advice that was valid before the law changed.

    Ok, put that to one side.

    You could try the letter to PE as I suggest, but as I said, you are likely to get an admin fee.

    The alternative is if you let it go to court to look through the forum for how to handle court papers and what to do that may have been posted by zzzLazyDaisy who is a solicitor. I am really sorry, but can't point you to the best thread - when she comes along, she might be able to do that.

    There are, unfortunately, lots of posts she has done as she is incredibly helpful and, of course, there are others too who have the relevant experience.

    You do need to get your acknowledgement in or ask for more time, but wait for the experts.

    Hope they don't stop reading at your earlier post as they are really on the ball ! ;)

    I didn't read anyone accusing you of working for Parking Eye !

    As I said, I see 2 routes.

    1. You could write to Parking Eye as I suggested and they might be prepared to halt proceedings but you won't know if they would or what conditions they would attach. I just gave you a heads up on what they have done in the past.

    2. You respond to the court papers. Now I am NOT an expert on that side of things at all. You need to wait to see if anyone who is takes up the thread. I have given you the best I can for the moment and if you use the SEARCH facility on this forum using words like "Court papers" or look for zzzLazyDaisy's posts using the search or similar, you could use the waiting time usefully.
