I am only just coming to terms with a close bereavement and really feel for you. We can help you but don't rush to send this appeal until we have all chipped in by the weekend.
Did your Notice to Keeper look like this recent one from September?

I think we need a paragraph about breach of the BPA CoP and POFA 2012, and breach of the CPUTR 2008 and UTCCR 1999 as well as the Equality Act.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I won't rush it and will leave it up for any other additions/advice for now.
It sounds good to me, mine would be more long winded for sure, about how he let me park there (it wasn't specifically a warden, as the car park doesn't have them..more a guy in a car catching people out/duping people) and about what has happened but I guess that doesn't matter to them and I will just come across as an emotional rambling wreck. Do I need my own photographs or just those facts?
It is good to know though this has made me less trusting in general, that there are some real helpful people out there, who do help, just because they can. Thanks again.0 -

As annoying and irritating as this parking [STRIKE]chimp[/STRIKE] guy has proved to be, this is more by way of background setting. Using it as a freestanding appeal point will almost certainly be overlooked by POPLA as they will see it as a 'mitigating circumstance' which (despite their Lead Assessor stating to the contrary in the POPLA Annual Report) they will totally ignore - hypocritical, but, from evidence, true.
We're getting there, so try to put all this out of your mind over the weekend. I'm more determined on this than any other case I've advised on.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If this is the initial NtK issued after 28 days of NtD, but before 56 days then there's no possibility that the appeal date has expired. At the same time there is no reference to POPLA, which they are surely required to include!Please note, we are not a legal advice forum. I suspect there is reference to POPLA on the back but it doesn't save them if the OP's Notice to Keeper is like that as regards 'Appeals Procedure' on the front. It's in breach of the CPUTR 2008 to put such misleading stuff on this notice (as well as the actions of the employee in the car park who actually gave this lady verbal permission to park).

Hi the original one said I hadn't paid the PCN on window screen (the one that most have been attached and took off) and that I would have had chance to appeal within 28 days but that had elapsed.
I explained the incident, asked for POPLA code and asked for evidence. This was the September letter , it was a 'template' letter by the 'As per photographic evidence it was clear your car was parked without a valid permit or authority and if you look at the photographic evidence we have sent you, you can see from the photos that there is sufficient signage around the site to make you aware or restrictions at that site' ...considered everything in your correspondence it does not contain enough grounds to uphold your appeal. If you still want to make further representation with additional evidence, do so within 7 days...blablabla....although that letter arrived the day before 7 days was up....so this time they didn't provide POPLA but mentioned them, different wording...You may also appeal to an independent assessor through POPLA (parking on private land appeals) details of which will be sent at the appropriate time if requested.
This current letter is much shorter. The usual....can only address factual issues of where parked...not enter discussions on legality of parking on private land or of the landowners right to impose parking conditions on their property. As your appeal has now been rejected for the reason stated, you may now 1 pay the parking charge notice within 14 days. Please not that any discounted rate, which may have existed (erm they told me that had gone in the first letter!) will not be applicable and the parking charge notice will be & # xA3; 100 (?) 2 Make an appeal to POPLA. The independent appeals service by making you appeal online at........f you opt to pay the parking charge you will be unable to appeal to POPLA 3 If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed to take court action against you, You ten digit reference is.....
It does contain the reason for issue (parking without a valid permit or authority) the location and the date.0 -
I still think we should keep things simple here and not bring these additional points in, valid though they may be. My view - and please correct me if I am wrong BB - is that BB has a lot more on her plate and just needs to get this appeal off so she can park it till POPLA'S decision comes through.
That's why I did a template draft and asked you guys to add to it rather than posing further questions to a distressed lady who is finding get it hard at present.
I actually think the amended draft would win as it stands, but if you have other points to add, that would be great but can I ask that you add the relevant wording to the latest version of the draft so all BB has to do is add the details and get it off?

Yes simple is good. I don't mind at all reading anything or answering questions but I do feel quite unwell. I am going for bloods redone today as I am very anaemic and feel terrible. In a way its good to have a few minutes to focus on something else but too much battling might lead to a bigger slump. The health probs seems to be flaring up, hormone slump no doubt.They don't seem to care about people with health disabilities or the stress they cause, getting threatened with recovering the monies and wondering if the bailiff's would be at the door. Also the fact this horrid devious man who obviously has no morals, had my address and details. This all didn't help when I was expecting. It was the happiest , most fulfilled of my life and in respect of that, they will have to prize the sofa off my butt to get anything of me.

It's gone quiet here. I don't really mind how easy/complicated it gets as long as this is done within the right time with a chance of winning. I don't know if this is all done or if there is anything I need to do, like take photographs or anything?
Is it good to go, or do I need more?

We're still here, haven't gone away. The forum has been frantic the past 48 hours with dozens of new threads that are in the process of being answered.
We were just leaving your thread for a few more days to see, once the rush is over, if anyone else wanted to contribute to the appeal.
In terms of photos of signage, I don't think they are vital and no need to go out specifically to take any, but if you're passing and can take some we could have a look at them
If they're obviously non compliant we would certainky use them for POPLA, if they're 'marginal', in themselves, they won't be showstoppers. If you are taking pics try to also get one of the entrance to the car park, which should have conspicuous compliant signs on show there.
