  • Sorry - to clarify, it was this bit I was referring to:

22.8 You must acknowledge or reply to the challenge within
    14 days of receiving it.

    And they haven't done either.

Yes but that won't help; and a PPC would say that if you sent the appeal online then the fact it was confirmed 'received' was the acknowledgement.

Just wait for the response. Don't rattle any cages except that of the retailer.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I sent the rejection via old fashioned paper post with proof of posting.

14 days is a very 'weak' argument and will NEVER win the day for you, much stronger arguments available, so don't get sidetracked with this.

Wait for the rejection, then we're in business.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Cheers Umkomaas - I assume if they choose not to respond within 35 days then that's game over for them?
I might mark it on the advent calendar ;)

It's never 'game over' until POPLA says or the PPC writes to say 'Parking Charge cancelled'.

The 35 days is very definitely a moveable feast since ParkingEye muddied the water with the BPA.

Don't bother checking it out, it's not worth the search effort, but, by the same token, don't rely on the 35-day rule!

  • So in other words, the AOS CoP isn't worth the pdf it's written on, and they can choose to reply any time between now and doomsday? ;)
  • Friendly letter from the laughable idiots on my mat when I returned:

"Whilst we sympathise with the situation" - I asked for no sympathy, just answers to my questions.

None were forthcoming to my standard proof of contract and GPEOL questions:
"We will not enter into discussions about the legality of parking on private land or of the landowners [sic] right to impose parking conditions on their property"

Best of all, no fugging POPLA code, despite me explicitly asking for it in my challenge, just:
"You may also appeal to an independent assessor through POPLA details of which will be sent at the appropriate time if requested"

The work of Mr. Cut O'Paste I do believe.

    Thoughts please? Enough rope yet?

Google 'ukcps appropriate time site:forums.pepipoo.com' to read how often they send that template letter because it's always mentioned.

Respond and demand the POPLA code like on all the other threads you will find in your Google search results. It will arrive. Tell them now is the appropriate time and remind them they are in breach of the POPLA requirements, like the version I typed here (you only had to look for other threads to find this one from today and be aware that we can't do the same reply 'ad infinitum'):

HTH - always search & read other threads first when you get a new letter. The answer is already here, 99.9% of the time someone's had your letter before.

  • Those chickenshit crybabies UKCPS have folded like a wet kleenex and cancelled the PCN three weeks before POPLA were due to adjudicate! Must've been something to do with the enormous failings in running the car park that I pointed out to POPLA...

Thanks to all the people on here who helped [even the more preachy ones "have you not read these 598 (all subtly different) posts before asking?"] ;) and the Parking Cowboys site in particular.

Despite being a customer of over 30 years, I will never buy from Maplin Electronics ever again as the CEO didn't even get one of his underlings to send so much as a post-it note to acknowledge my letter pointing out what a bunch of incompetent !!!!!! he was indirectly employing.
