Proof of leaving site

Hi all you helpful people
,
I got stung the other day with one of UKCPS's pretend tickets; the clause they used on is 'leaving site' (I visited one of the retailers onsite, but then left site for a few minutes before returning to the car).
Has anyone got any experience on fighting one of these? The place wasn't exactly ringed with CCTV, it was just a smallish place - how do they prove I left, or do they just have to rely on the word of the gonk in the van?
Other smaller (possibly too small?) details are that they got the make of car wrong and said gonk hadn't filled in the 'Issued By' - too trivial to invalidate it?
Any help most gratefully received!

Don't focus on the in's and out's of their nonsense. Look at the overall picture. Do they have a contract with the landowners sufficient to give them authority? And will they divulge details to prove it if they do? Are their "charges" anything other than a penalty,?
Look at the numerous threads here for guidance on how to appeal to UKCPS then hit then at POPLA.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
As with all of these, you will win at POPLA with our help.
First of all, dates !
Date of contravention
Did you get a windscreen ticket
Did you get a postal Notice to keeper and if so what date
Was this in England and do you live in Scotland?

EDITED to add the linky that was missing from Guys Dad's post, see above link.
And here's the link I normally supply which says something very similar:
http://forums.pepipoo.com/index.php?showtopic=83749&st=0&gopid=874216
Same advice as you will see on every single thread here. And Google 'UKCPS address the factual issues' to read similar threads to yours, to see what letters arrive when, and how to respond, to appeal properly. and to get a POPLA code and win.
And of course complain to the retail park Managers this week, now!!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

To be honest, it's not even legal that ticket. Unless you're serving time at her majestys pleasure or in the custody of the police, you cannot be legally restricted to any position or place by a private company. Likewise the fact that they monitored you going in and coming out of the store (where you WERE a customer) is harassment. If it's CCTV there are very strict laws on the use of CCTV especially when monitoring individuals. I would suspect however that in truth it's a little bloke in a small cabin somewhere watching with his eyes and that being the case he'll have written records and photos so he can track all the customers. There may even be a camera involved too - again data protection / harassment.
Human rights, Data protection, possible misuse of CCTV... personally I say fight it all the way. B*ll*ks to them.0 -
If there was somebody on the ground watching , then they should have made an attempt to minimise their "losses" by confronting you and telling you of their T&Cs. This point was bought up in the famous VCS v Ibbotson case. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Thanks all for the quick replies!
@Guys Dad: 28/09/13, windscreen, not yet, England & live in England.0 -
ok. Wait for the NTK as they can screw that up. Just read the latest successes on the POPLA Decisions sticky for reassurance.0

Hi Multistory

Here's a thread link to my current situation:
https://forums.moneysavingexpert.com/discussion/4747826
which is very similar to yours. I've just gotten my notice to keeper letter so follow my thread if you feel it fits and you can see how it progresses. I reckon I can win at POPLA after all the brilliant advice from the various members.0 -
nice one michaelalou - I'll be following your progress with interest!0

Don't "fight", just ignore. Any other advice (I have this on extremely good authority) is coming from the scammers' representatives. Go back to ground zero and follow the original advice posted here. The civil law of the nation hasn't changed in the meantime. If we all ignored, this bol****s would end overnight.0
