Sports Direct.com - sent me wrong sized item

Hi,

I bought a pair of shoes online, paid extra for next day delivery as I'm going away for a few weeks.

They sent me the wrong size. Returns seems like a long process, involving paperwork & returning items. No contact/phone numbers etc.

What can I do? I'm going away in 3 days & need these shoes for that trip.

They dont have the sizes in store hence me having to buy online in the 1st place!

    Order the new set for next day delivery, return the old ones under distance selling regs. At least you stand a chance of getting them in time and you start the paperwork to get rid of the wrong ones in parallel instead of waiting for the returns to process before getting the right ones?

    I went back my local SD. They didnt have my size, but offered me an alternative that was £5 dearer (but the same price as mine had I bought them online), so I refused.

    Looks like I'll try your strategy.

    What a nightmare organisation to deal with once theyve got your money.

Please fill out the necessary details at the bottom of your invoice clearly stating the reason for return and whether you require a refund or exchange.

    You may cancel your order any time within seven (7) working days, beginning on the day after you received the goods. We will refund the price of the goods in full, however the delivery costs originally paid are non-refundable unless your entire order is cancelled within seven (7) working days of receipt of goods.

    You will be responsible for the cost of returning the goods to us

    Theyve properly shafted me. Something that should have cost me £12 has now ended up costing me £24!!!

    Surely when a company makes an error, they should should just man up & take the hit?

    I tell a lie, £12 footwear has ended up costing £36! 12+6 p&p - twice!

    You should reject them under the SoGA rather than DSR as they are not as described. They would then be liable for the cost to return them (and also return the whole some paid)
  • You need to claim the postage from them - both outbound and return. You are legally entitled to this under the Sale of Goods Act as the goods you received are not what you ordered.

    paddyrgs advice above to return under the DSRs leaves you liable for return postage costs. The Sale of Goods Act is the best one for you in this case.

    I was just thinking under SoGA they may not dispatch until the rejected goods are returned, and OP's post centred on the time being the urgent factor.

    Appreciate the advice folks.

    I've re-ordered in desperation as I really need the item - what should I do with the wrongly sent items? ( also ordered a few accessories- which we will keep, to make me feel better about paying for next day delivery)
