in Credit cards
I went on holiday to Turkey few weeks ago and in a moment of madness bought a diamond ring for my wife. The shop was big, in the middle of a town shopping centre so did not look dodgey. I paid £600 by credit card and the seller assured me that the ring will be worth at least £1000 in the UK as they charge very little for Labour in Turkey. I took the ring today for valuation and the best price I could get for it was £350 as the diamond was not pure !!! Now I know that there is point contacting the shop but I am wondering if I could dispute the purchase as I paid by cc !! do I have a chance?

So which part of the CCA are you claiming under, misrepresentation ?
Did the seller actually say it was a pure diamond or did you assume ? Do you have anything in writing ?0 -
Sorry I dont know which section and that is why I am asking. I do have a guarantee certificate confirming the specifics of the ring and the paid price0

confirming the specifics of the ring
The sellers assurances seem incorrect but it would be your word against theirs.
On the face of it I'd say you are entitled in a legal sense to believe what the shop assistance told you (although most people would think this naive especially in Turkey).
It really depends on how helpful your card company want to be because they can chargeback the amount to the retailers bank and don't have to pay for it themselves.
I wouldn't say your chances are high because the shop will most likely deny everything, but I also think you are entitled to believe what a shop assistance tells you. The problem is you have no way to prove it.0 -
Any valuation by someone buying the ring is worthless and traders blag.Be happy...;)0

thank you for the replies..I went to 3 jewellers at the famous Birmingham Jewellery quarter and £350 was actually the best quote...the two others quoted £300..so considering that these things should be cheaper in Turkey than in the UK this is not right..by the way the store has a web site which ends .co.uk although all contact numbers are in Turkey !!0

What did the person in the shop say precisely?
If they were referring to UK RRP then this is possibly quite different to what you are an individual can sell a used ring for.
Is it possible there was a misunderstanding here?
Can you confirm if there is anything actually incorrect about the written specifics?
You have not actually answered this question.
It sounds to me like they were saying you'd pay £1000 for that in a UK shop which is not inconsistent with a second hand personal sale for £350.
I don't actually now think you'd have a case because of course there is a big difference to what shops sell NEW jewelry for and what you can sell a USED ring for. There is a huge markup on jewelry so none of it some inconsistent to me.
If you took a ring from Samuels or Ernest Jones and tried to sell them USED to a jeweler you'd get the same result in the UK.
You are not offering the services of a shop, you do not have a NEW ring to sell you have a used one, so there is bound to be a difference. It's big - but yes there's a big markup on jewelry.0 -
I do have a guarantee certificate confirming the specifics of the ring and the paid price
What exactly are the specifics? You can't possibly give a valid answer without knowing this.
I suspect it's a case of Caveat Emptor in which case your card card company will have no case to answer and you can put it down to naivety.
However, don't let that sop you from asking if you're sure you've been 'had'.0 -
the 3 jewellers who looked at it today all said that he diamond was not pure, was mixed with other stuff and as such there is no way it is worth more than £350 at best UK prices..considering they pay peanuts for labour in Turkey, this should have been even cheaper there. I agree that I might have to take it on the chin and move on but I am not prepared to do that without a fight0
