Road tax, applying 1 week Later than renewal date?

    Finance Act 2013:

    188 Not exhibiting licence: period of grace

    ...
    (1)A person is not guilty of an offence under subsection (1) or (1A) of section 33 by using or keeping a vehicle on a public road during any of the following periods.

    ...
    • Renewal etc.
      The period of 14 days following the time when a licence or nil licence for or in respect of the vehicle, or a relevant declaration applying to the vehicle, ceases to be in force, but only if an application for a licence or nil licence for or in respect of the vehicle to run from that time has been received before that time.
    My underlining. I didn't realise that the 5 days had been increased to 14, but the rules still only apply if you apply for tax before the old one expires.

    There's no mention of re-licensing after SORN.

    That declaration is SORN, s.22(1D), & 33(1D) (a)(b) - Vehicles Excise & Registration Act 1994.
    A SORN declaration ceases to be in force by taking out a new licence, which is when the grace period starts.

    Can't you get it now?

    Dunno what the 20th is all about, I got mine online on the 7th of September, (expires on 30th September)

    Even stuck it in the car for once, rather than forgetting all about it.

    No idea what date range was on the renewal.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    You have 14 days before you need to display the new disc if you applied before your old disc expired.
    The grace period only applies if you apply before your old disc expires, if the car is sorn you must wait until you get the disc before driving on the road.

    No, the 14 days grace also applies when a SORN declaration ceases to be in force - by taking out a new licence. (see post 15)

    If it helps, on the reminder for my tax disc received not long ago, it says:

    "If you can't tax on time:
    By law, you as the registered keeper will not be committing an offence as long as you tax the vehicle or make a SORN within 14 days of the date your tax disc or SORN runs out. However you must keep your vehicle off the road during that time"

  • you can use your reminder from the 5th of the month before your tax is due to expire. the best advice is to tax before you go and leave both discs visible in the window.

    There isn't any real point declaring a SORN for those few days, especially if you intend to tax consecutively and if you want to tax at a post office, using the barcode to SORN will invalidate the reminder and you might need to then dig out your V5C to tax.

    No harm in doing it online either but the best advice is to keep it off the road until you get a disc. The DVLA won't issue a failure to tax fine for such a short period of time but as per previous comments if you choose to drive it to the PO to tax after you get back then you can get a failure to display etc....
