Used car from dealer issue, can we insist on a fix?

you state that its been in for repair many times and you still have issues.
I would have rejected it regardless if they say they ordered a driveshaft or not, anywhere when did this come into the equation.
juddering wheel (which now they say is a tyre issue). Its a clear case they are just giving you B S and the runaround.0 -

Possibly, but there are reasons why OH has decided to give them this last chance to fix.
He's fitted a fair bit of audio equipment and bluetooth into the car which would take time to remove and is specific to the vehicle.
They took our car in part ex and the numberplate which was on it is being transferred on to the focus, thats in process at present.
I think they realise at this point that we are ready to reject and as such have pulled their fingers out a bit. Should they fail to fix the drive shaft then that will be it, car will be rejected.0 -
Fair enough, but you do have to ask yourself, why did the drive shaft go on a 3yo car in the first place?Accept your past without regret, handle your present with confidence and face your future without fear0

I asked OH that this morning....I'm yet to get an answer. The car has 60k on the clock and FSH with Ford so it has been reasonably well looked after.0 -

I wonder if that could be seen as "any act ... which is inconsistent with the ownership of the seller"?
In other words, by fitting the audio stuff, could he be seen to have accepted the vehicle?
From SoGA Section 35, (1)(b)0 -

Possibly, but I would have thought the fact that the car was misrepresented at the time of sale (when it was asked if it had ever been in an accident and the reply was that it hadn't), would give enough of a reason for the car to be rejected irrespective of the audio equipment being fitted.0
