my mistake with the dates, as said I have pre-occupied with family funerals and grief (3) in six weeks
date of incident : 3/08/13
1st letter issued 09/08/13 - lost
2nd letter - reminder date says 18/08/13
3rd letter - 12/09 which states 29 days have gone so cannot appeal and says have 14 days to pay before further action
no window ticket, my head is totally confused I have read alsorts over last couple of days and must admit am completely lost and looks like I will have to borrow money to pay0 -

Don't be daft. NO-ONE HERE PAYS!!!
Have you forgotten all the advice above when we thought you were too late (technically) to appeal? So back to that advice then because it's past 28 days since the first letter.
You can still try an appeal mentioning that you have complained to the landowner, enclosing copy receipts or details of the wedding perhaps, if you were using an establishment on site. And complain to the landowner/hotel simply by Googling the name of the place!
So sorry to read about your losses. I have also just suffered a very close bereavement of a young relative just weeks ago and life's difficult when you are grieving. We do understand what happened and why you couldn't respond yet.
But you do need to complain and try an appeal anyway rather than roll over and pay like some sad scam victim. Complaining is most important IMHO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for all the help people are giving to start with, I think the last letter I got is the LBA or its the one just before, as it does mention its the FINAL notice before further action in it, I have come across this thread Parking eye and DRP at it again post #16 is a draft LBA letter, I cant post the link

We need to be clear what letter you have received, in order to be able to help you with a response.
So please can you tell us:
The date on the letter you are referring to; and
Does it actually state that it is a 'letter before action' or a 'letter before county court claim'; and
Is it sent from ParkingEye Legal Department?
(the reason for the questions is that sometimes PE use a debt recovery company that sends letters marked 'notice of intended litigation' or similar, but that is NOT a letter before action)

starts :
dear sir
the requirements of Schedule 4 of the protection of Freedoms Act required for keeper liability have now been satisfied and as a result we have the right to recover any unpaid parking charge from you, the registered keeper
blah
blah 29 days past amount now £100 payable within 14 days to avid further action
if letter ignored further action may be taken such as instruction of solicitors.......0 -
That's not a LBCCC or a LBA, that's the one they use to say they reckon they have established keeper liability. If you were not driving now's the time to give a name and address...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Coupon-Mad is spot on. That letter is not an LBA or LBCCC, so there is no point in replying to it.
At the moment your options remain as:
1 Appeal, and try and get a POPLA code out of them; and
2 Contact the landowner, explain the situation and ask them to get the charge cancelled.
If neither of the above works, then wait until you get a letter headed 'Letter Before County Court Claim'. It will say it is fully complaint with the Practice Direction, which is a BIG FAT LIE.
When that happens go here and follow the instructions. Come back when you have got as far as you can go and we will help you from there.

landowner is town council and it would be easier getting blood out of a stone then or them to cancel it
if I was to appeal at this stage is there any sample / templates of letters I could use, as TBH none of this make any sense to me tied reading but it just gives me a headache, but could probably edit a standard letter if there is one
