    Would they not break into my house and take my stuff anyway

    In theory , if they've signed a walking possession order they can break in to remove goods if a person has defaulted.
    They told me they can peacefully gain entry without me even being there

    Again, in theory they could.
    you can ask a judge when the papers come through to set the terms.
    What papers ?
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    My outstanding balance now is £222.31. i have to pay £58 before the 12th of each month. i have made paid £60.00 each month for the past 6 months. They made a list of all my goods including TV, Laptop, dining room set. My daughters xbox.
    I havnt got all the paperwork on me at the moment just all that they gave me yesterday which was a default notice first posted through my letterbox and then when he came back to my property after me arguing to him and his boss on the phone he filed another agreement and a receipt for the £160.

    I can assure you do not owe £222.31 they owe you how much they owe you will depend on the amount of the liability order

    before yesterdays visit can you confirm how many payments of £61.50 you paid

    iv made payments of £61.50 for 6 months. i know they charge £1.50 for using card over the internet. i have all the confirmation emails and also took note of the reference numbers when paid. i have always paid between the 6th and 11th for the following 4th. its only this month they seem to think yts too early and is seeing it as an overpayment for the 4th before. i just don't get it, i don't know how they can justify this. i wasntg late paying there has been no late payment. i pay it early 3 weeks aprox in advance. i make sure i don't pay until after the 4th to prevent it being seen as an over payment. i don't expect a reward for being up to date and organised but i expect to be left alone.
    Sould someone please tell me how i can complain about this and too whom. im furious they can do this. im glad the £160 has come of my debt but furious they can do this pick and choose what they charge demand what they want and when and their behaviour is just so out of order. i don't wanna let this rest i want an apology at least.

    They told me on the phone that I owed £565
    Most bailiff fees are set in legislation when and what a fee is charged is also set in legislation

    If the bailiff demanded £565 before the levy on goods you can safely say it includes 1st and 2nd visit fees ( no other fees can been added to this debt prior to the levy

    broken down it should be
    outstanding balance against the liability order £513,50
    Ist visit fee £24,50
    2nd visit £18
    total bailiff fees £42.50
    you now owe £565

    Bailiff then attends to levy your goods against the debt (liability amount only £513.50) a levy fee against this debt would be £41
    you signed the walking possession a fee of £12 can be charged for this (no other fees can be charged against this debt on the day of the levy ) you now owe
    outstanding balance £513.50
    1st visit fee £24.40
    2nd visit fee £18
    levy fee £41
    walking possession fee £12
    total bailiff fees £95.50
    you now owe £609
    you paid payments of 1 x £250 and 6x £60 (the amount being taken of the debt) total paid £610

    The above fees are correct and set in legislation (the levy fee is worked out on the amount of the liability order £513.50)
    Looks like you paid the debt and lawful bailiff fees in full before the bailiffs visit to remove goods

    The next fee would be an attendance to remove if you had defaulted on your account their is no set fee for this legislation quotes
    Reasonable costs and fees incurred

    looks like they charge £160 attendance to remove fee which you paid

    you have now paid £770 with an outstanding balance of £222.31 total £992.31
    therefore in total the bailiff/ ross & Roberts are charging you £478.81 in bailiff fees

    I now have all forms in front of me.
    I have 2 notices of seizure and inventory of goods both issued on the 4/4/13

    form 1

    Amount owing council tax £266.21
    Balliff costs(inc VAT) £241.50
    total amount if paid today £507.71

    List of goods includes well I cant read his handwriting for some but includes my daughters x box table lamp cd rack, dvd's and cd;s

    Form 2

    Amount owing council tax £311.60
    Balliff costs (inc VAT) £45.oo
    Total amount if paid today £356.60

    goods include microwave, washer, tv, table, dining chairs 2 &3 seater leather sofa, coffee table, display cabinet, computer and the desk

    I paid that day (4/4/13) £286.80 apparently this was too set up agreement but I cant seem to find the receipt for this but will keep looking.

    then there is the agreement that I signed

    Outstanding amount £577.31
    arrangement amount £58.00pm
    First payment due 4/5/13

    Dates I paid I have a reference number for each

    20/4/13 - £61.00
    9/5/13 - £59.00
    6/6/13 - £60.00
    6/7/13 - 59.50
    6/8/13 - £59.50
    9/9/13 - £61.50

    £155 overcharged at this stage of enforcement

    I wish you could read what else is levied however the goods listed wouldn't cover all bailiff fees including removal storage auction fees and a portion of the debt the x box is your daughters and shouldn't be included this could make the levy unlawful

    Balliff costs (inc VAT) £45.oo
    Total amount if paid today £356.60


    levy fee £33
    walking possession fee £12 (this is assuming you signed both the walking possession agreement's )
    total bailiff fees £45

    washer ,table, 2 seater sofa and 2 dining chairs exempt goods

    bailiff cant charge multiple fees when enforcing more than one liability order most bailiffs levy the same goods this bailiff has levied different goods for both accounts this increase's the amount he can charge for the levy fees and charge 2 walking possession fees

    have a look at the bailiff register to confirm the bailiff is certificated to ross&roberts

    I will come back to this tomorrow late afternoon you will have to make FORMAL COMPLAINT I will tell you what to put in your letter

    you need to address it to CEO of your council I would also suggest you send a copy of the letter to your MP and local councillors

    did you confirm the certificate detail's of the bailiff

  • I hate bailiffs. They really are scum.

    I agree, I am all for people paying there own way etc etc but bailiffs really are the lowest of the low. You must have to pass a zero humanity exam to become one.
    I have come across them a few times in my life via various means and they are nasty people.
