Request for documentation denied

Hey... First time poster..

So... I sent an initial letter to my bank, requesting my credit agreement from a mortgage I had around 6 years ago, with a view to starting a PPI claim. I enclosed a PO for £1.

Today I received a reply....

Thank you for letter blah blah...

The consumer credit act 1974 only relates to regulated credit agreements and your mortgage agreement is not covered by CCA regulations.

I trust this is satisfactory.......here's ya quid back! ( or words to that effect)

So the question is what do I do now?

Any advice would be greatly appreciated....cheers

    You could respond with a Subject Access Request (SAR) requesting ALL information they hold on you. The statutory charge for this is £10, and no credit agreement is required.

    It means you don't need a credit agreement (CA) to make a PPI mis-selling complaint.

    You are obviously trying to complain about MORTGAGE PPI, but using advice clearly aimed at those who have credit card or loan PPI. You are misguided.

    Most mortgage PPI complaints are rejected because it is the one type of payment protection insurance worth having (even today).

    What reason do you have for complaining that your mortgage insurance was mis-sold to you?

    Most mortgage PPI does cover the self employed, have you checked yours?
    Being "naive" is not a valid complaint.
    If they told you it was compulsory when it wasn't then that is mis-selling, but what evidence can you produce that you were told this?


    As I said, you are attempting to use advice designed for people with loan or credit card PPI, very little of which applies to your mortgage PPI.

    Since most mortgage PPI complaints are rejected then the answer is no I'm afraid.

    You need to look for valid (and preferably) verifiable complaint reasons. You need to find out if there were any exclusions in the insurance which made it unsuitable for you.

    Mortgages are only granted after a full "demands and needs" investigation is carried out, so the chances of it being unsuitable are very low.

    You can make a complaint, but without any evidence, it is doomed to failure.

    No, the Bank have already told you in their letter that your mortgage is not covered by CCA regulations. They don't have to provide any agreement.
    To complain all you need are the mortgage account number and valid complaint reasons. You appear to have neither. You can send £10 to them and request they send everything they've kept on file for you. In your case, I would wager it'll be a waste of £10.

    It is something I intend to persue. So..can I insist on a copy of my original credit agreement without being fobbed off or do I need to go down the SAR route as mentioned above?
