Parking Eye PCN Notice, Tower Road Newquay

  • Just to confirm its the Tower St car park that we were on and not the actual church car park.
    I'm trying to find out who the landowner is currently but with no success at the moment.

    Tower Road ( entry via Bunker Caf! and Mini Golf ) £7.20 all day until 10pm

    Parking charges apply seven days a week 8am to 10pm
    No parking outside these times

    The owner of this car park does need to be 'outed'
  • Called the Bunker Caf! today. The guy that I spoke with told me that the landowner of the Tower Road car park is Newquay Golf Club.
    I'm planning to confirm this with them.
    Unsure whether writing to them to complain will yield any result but willing to try.

    Newquay Golf Club also use PE for their car park which is immediately adjacent. The GC car park is members and visitors only, no P&D. Log your vehicle reg in at the pro shop.

    This is the car park that we used, bought ticket from the ticket machine near the Bunker Caf! entrance. We were directed to park on a grassy area by a parking attendant when we arrived.
    Area that we used was definitely pay and display car park.

    EHBA, you mention 'parking charges apply 8am - 10 pm'. This is what we paid for (we paid £7.50 in fact as the parking machine gave no change) Our ticket shows expiry at 10pm. We returned to our car and left the car park at 10.27pm. As I mentioned in an earlier post we were going to buy further parking time (10.00pm - 10.27pm) to cover the extra however the sign on the car park said something about charges applying 8am to 10pm, thus we did not buy any further time. We assumed that this was ok.....

    OP - I wouldn't worry about the minutiae of this case, don't get bogged down with mitigating circumstances. As much as you feel them important - and a point of frustration - they have little or no importance in all of this stuff. Your main task is to get this to POPLA, where, with our help, you can kill this off.

    So soft appeal to PE to prise out the POPLA verification code, then go down the 'contract with landowner' and 'pre-estimate of losses' routes (plus a pile of other points as back-stop insurance) to POPLA, for an almost guaranteed win.

    You are right Umkomaas, sorry I got carried away, just really frustrated at receiving PCN after such a great holiday....it's taken the shine our brill family holiday in Newquay.

    Totally agree, don't take your eye off the ball! By all means complain to the golf club but only AFTER you have sent off a challenge to PE about unclear signage and the charge doesn't represent any loss (do not name the driver nor imply it).

    I have confirmed with the golf club that the Tower Road car park is actually owned by them. I have currently not written a letter of complaint to them yet. Instead I took your advice and have drafted out a simple letter to PE to complain. I have attached it to this post and would welcome advice on any adjustments that I need to make before sending !....like I say I'm no expert on this..

    I did read a few of the other threads about Tower Road but have to say I was a little confused over some of the jargon/reasoning that was included in some of the posts....

    Anyway here is the letter that I plan to send to PE...any advice appreciated...

    Proposed Complaint Letter To Parking Eye

    "Haverecently returned from a family holiday in Newquay, Cornwall.
    Unfortunately we now find ourselves in receipt of a PCN for £100 (or £60 if wepay within 14 days) from Parking Eye having used the Tower Road car park.

    We paid £7.50 for what we understood to be a 'full day' ticket.
    When we returned to our car at 10.30pm we then noticed that the ticket hadactually expired at 10.00pm exactly.

    We attempted to read the accompanying parking sign displaying charges etc onthe car park which we found almost impossible as it was not illuminated. Fromwhat we could read, and understand, it was possible to pay the extra charge bybuying a further ticket before leaving the car park. This we were going to do,but reading the sign further, our understanding was that this was unnecessaryas the car park charging actually finished at 10.00pm. We therefore did not purchase anyextension to our parking ticket as we understood that this was not required.

    Unfortunately I cannot find any information available regarding the charges/terms andconditions for this particular car park in order to confirm our actions wereright or wrong. I would therefore like to strongly appeal against the PCNissued by Parking Eye as;

    1) Wefeel that the signage was unclear to read due to no illumination and alsomisleading and unclear in its possible intention.

    2) Secondlywe feel that the proposed charge of £100 in recompense for any lossesthat could possibly have been incurred due to these circumstances is completelyunrealistic.

    I wouldstrongly request that the PCN issued be withdrawn. If this is not possible thenI would request that you supply a POPLA reference as I will certainly appealagainst this unrealistic charge."
