    About fighting it, well I can't see how they can have any proof? They haven't sent any throughout this process. If they have gone this far does that mean they do and they think they will win?
    That is, of course, the $64,000 question. They almost certainly believe that they do but up to this point they have been under no obligation to produce any evidence. They still don't have to produce that evidence yet but in their more detailed PoC they must demonstrate, on paper, that they have "a cause of action". If they fail to do so or fail to do so in time then they are hindering your ability to defend yourself and you can make application that the Court "strikes the matter out". But let's stick to taking things step-by-step and see whether a more detailed PoC appears.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • What annoys me about these cases is that there is not a hope in hell of you keeping a ticket for two years or more so there's more chance of someone just keeping them quiet by paying.

    What annoys me about these cases is that there is not a hope in hell of you keeping a ticket for two years or more so there's more chance of someone just keeping them quiet by paying.

    That's an interesting point, I am aware that a contractual debt can be pursued for up to six years, longer if you have acknowledged the debt. But could it not be argued that a period of two years from the issuing of the ticket/invoice to commencement of legal proceedings is an undue delay and an abuse of process?

    Indeed it could & it's a very good point to bring to the notice of the court.

    Most of the documents are photocopies yes.

    How do I check it online? Nottingham is no where near me.

    You get to choose the court later on, so it won't be at Nottingham if it goes to a hearing.

    If it is real then you need to acknowledge the claim - as explained in the letter you have, did the letter come from the Court? It is not a summons, this is only a small claim decision which you can influence if you defend it well and in time.

    Go to https://www.moneyclaim.gov.uk/web/mcol/welcome. I think you'll need to register and then check the reference number given on the 'court papers' from GPB to see what that delivers.

    Alternatively wait until Monday and give the Northampton Court a phone call to check whether documents are real and apply to you. If they don't apply to you, ask the advice of the person you're dealing with what you should do if the papers have been falsified.

    I'm not the expert on MCOL, but if I'm not mistaken (and someone will correct me if I am) there should be a reference number/password shown on the court papers you have received in order to log in to your particular case on MCOL - can anyone else confirm this?
