Ordered a window blind, doesn't fit - my rights?

I ordered a window blind, I went into the shop and gave my measurements. I told the lady the width measurement was the blind width and the length measurement was the window length. I have also previously ordered from the same shop.

The fitter has been to fit the blind and says it isn't wide enough, apparently the width needed to have the brackets added on too. I didn't know this and the lady didnt ask me this. They offer a free measuring and fitting service yet I was never offered the measuring service, she just took my measurements and asked no more questions.

The fitter left and told me not to worry it was the lady's problem not mine and it would get sorted. Then the lady called me and said "we'll I'll have to keep this blind in stock now and hope someone buys it" . She was angling to charge me again but then said she would be fair and just charge me the £25 call out charge for the fitter to come out again. Well the website says the measuring and fitting is free! I said I would not pay an extra £25 so she said I will have to collect the blind and fit it myself.

Anyone know my rights? I'm worried in case I can't fit the blind, or in case it doesn't fit.

*reading this back, it reads like I made a mistake with the measuring. I didn't, I measured the width of the cloth of the blind and i told her that was what it was and I now suspect that she wrote it down as being the width of the window instead.

  • So you said you want the blind to be X wide, they have made it X wide and you've now realised you made a mistake? Presumably the blind was custom made to your size requirements?

Ultimately read the contract on what you agreed to. On the basis it is custom made your statutory rights are significantly reduced in terms of rejecting the item.

On the basis its your mistake £25 doesnt sound a bad deal -v- being lumped with a blind that doesnt fit and having to buy a whole new one. Just because a company offers a service doesnt mean they have to promote it to everyone.

No, I gave the width of the blind exactly the same as the one I have now, but she said I should have added the brackets to the width. She never told me that on the day, and she never offered me their free measurement service. So as far as I am concerned I measured the cloth width correctly and so no I have not now realised I have made a mistake!

She said to me after "this is the reason we measure up first". Well exactly, so why wasn't I offered a free measuring? I suspect she wanted to cut corners.

Actually, thinking about it now, I wonder if she's taken the cloth width and put it as the window width instead hence the blind not being wide enough. I thought I was perfectly clear on the day with what my measurements were.
  • For blinds, it is well know you have to measure from x-y to include for fittings. She must have just presumed as you came in with measurements that is what you wanted. As you gave her the blind width, not the "cloth" width.

If you went in to store and ordered, handing over your measurements. Without using their measuring service.

I don't think you'll get them to do anything, it is your word against theirs.

The fact they are sorting out a replacement blind for your measuring error is good IMVHO.

If it came down to it, installing blinds is not hugely difficult if you have a hammer action drill and some good drill bits. Are they giving you a blind of the correct size now?

when you measure for blinds you don't measure an existing blind, you measure a window.

Just because they offer a free measurement service with free fitting means nothing, you didn't use the measurement service, so why should your fitting be free?

You gave them the measurements you wanted, they made the blind to those measurements, if it doesn't fit that's down to you, its not up to the retailer to double check for you when they aren't in front of the window you want a blind for.

Can't see why you think this is the retailers fault?

OP clearly states they gave the retailer the width of the existing blind cloth, and stated this. Therefore if the new blind cloth is not the same width, they didn't make the new blind to those measurements, and it certainly is the retailers fault.

Reading what the OP stated they did provide blinds to the measurements provided by the OP, but the OP did not take into account the brackets.

is not the same as saying the blind cloth width

They are quite clear that they informed the retailer that this was not the width of the window, but was the width of the existing blinds cloth.

"I measured the width of the cloth of the blind and i told her that was what it was and I now suspect that she wrote it down as being the width of the window instead."

    and

"I thought I was perfectly clear on the day with what my measurements were."

No they were not, they edited when posters pointed out their error....me thinks an embellishment to save face.

Who exactly goes into a shop saying my measurements for blinds are 150cm cloth width and 150cm window length.

Why would he measure the window in one direction....giving the window length then measure the cloth in the other. That's asking for trouble.

He measured it wrong, end of. Due to the way blinds are fitted the whole window needs to be measured. He did not do that. Or he did...in the length.
