We thank everyone who responded to this alert concerning the debate proposed by Sheila Gilmore MP around the issue of WCA decisions, and we hope the discussions and decisions which took place during the course of the debate are of interest.
We just wanted to clarify that we are the official representative of the House of Commons on MoneySaving Expert and we distribute information on MSE to make sure that people on the forum are made aware of issues being debated inside the House of Commons which have a direct impact on members’ lives or which are common discussion topics on MSE.
We are here to make sure that people are made aware of what goes on inside the House of Commons and, if they wish, inform people of how they can affect the work that takes place in the Commons.
We want to stress we have no affiliation with the government. Parliament exists to scrutinise the work of the government and as such we would not and could not work on behalf of the government or comment on government policy.
We hope that this clarifies the issue.

Mr Hoban: I was about to conclude my speech, but I will give way once more as I am a generous man.
It's almost time for tea?
Sheila Gilmore: I understand the Minister’s concern about information and about ensuring that the process is carried out timeously. One suggestion that has emerged from the discussions is that the time for submitting the ESA50 could be extended from four to six weeks, which would give people more chance to get the necessary information together.
Mr Hoban: I thought that the hon. Lady’s motivation was to accelerate the process, to ensure that the right decisions were made as quickly as possible. Now she seems to be advocating delay by adding an extra two weeks to the process.
Mr Hoban, Do you realise how long the process can take, overall?
I am not sure that that would be in the interests of claimants, as they would face a longer assessment phase that would take them further away from the market if they were fit for work.
That just about sums it up?

Claims such as :-From October this year claimants will not be able to appeal against a ‘fit for work’ decision until they have first requested a ‘mandatory reconsideration’ by a DWP decision maker. Only if the claimant disagrees with this decision will they be able to take an appeal to a benefit tribunal. This process is likely to take months.UPDATE 13/6/13: Clarification, the DWP say that claimants ‘may’ be paid at the assessment rate once the ‘mandatory reconsideration’ has taken place if they pursue an appeal. There is no time limit on how long this process can take and this depends on whether they are able to provide medical evidence to the Department.After these changes to appeals come into effect, any claimants who disagrees with a decision made by Atos is likely to be forced to go without any benefit at all whilst ‘reconsiderations’ of their benefits take place. These people are not just already amongst the poorest in the country, but those with cancer, MS or other life threatening conditions.
I know from experience how long appeals can take. Not days, or weeks, not even months, a year or more, possibly even years. How are the poorest and most vulnerable in soceity supposed to live, in the meantime.
I've already stated this, previously. I'm not going to sign on for Jsa if know i'm not fit for work. Don't come back with there's a job for everyone. We all know the state of the economy, and health conditions vary from person to person. There's no black and white. There are undoubtedly people who are too ill to work. Who will be forced to sign on for Jsa. Stupidity, but what is the alternative? End up seriously in debt? live on the street? Death?
Worryingly :-A recent response to an FOI request (PDF) confirms that claimants will not be able to claim ESA whilst waiting for this process to be completed. The DWP say that claimants will instead have the: “option of applying for alternative benefits, such as Jobseekers Allowance, however they must meet the conditions of entitlement”.

Knowing how long it takes Dwp to respond to anything, this is frightening. I'm still waiting a call back from a specific advisor, which i've been awaiting for 3 weeks, now. Or is it 4 weeks?

Hi Ani26 - apologies - it is 'made aware' - we will correct!Perhaps someone, be it yourselves, the Dwp, or the House of Commons could clarify if Esa will still be payable whilst a claimant is in the process of mandatory reconsideration. Various terminologies which have been used, make it unclear if Esa will cease whilst the claimant takes the route of mandatory reconsideration.
We do not have this information however should a discussion or question concerning ESA come up in the Commons we will be sure to inform you and where we can we will post up the response to help you with this question.

The answer is no, Esa will not be paid, and it's just another way of prolonging an already stressful process?
And saving money?

It seems to me as though as though the horse has already bolted and the stable door firmly closed?
I'm not sure why there even was a debate, other than it can be said there was a debate in the HOC?
