• Hi All,

Thanks again for your advice.
We've received another letter - this time threatening court action.
Link to letter here:

Should we continue to ignore it or get a bit more worried?

Many thanks,

Yes continue to ignore, and ignore Zenith Collections who will write next, they are in fact DR+ pretending to be someone else
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Agree with Stroma - these are not court papers (or even the official start of court papers - this would be headed up 'Letter Before County Court Claim' or 'Letter Before Action').

If you get one of the above or Court Papers via Northampton County Court, come back to us.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My post #3 tells you about these letters, with links. :)

More importantly, how did you get on with the complaint and have you seen all the successes since August?

Farmfoods and Retail parks galore have cancelled when people are assertive enough. Rattle their cages again in angry customer mode even if you've done it already.

I've had no joy in finding out the owner of the car park.
Kept getting fobbed off by stores (that rent) there. :(
• If I were you I would drop an email to each of the retailers saying something along the lines of you are being harrassed and please could they provide the contact details of the managing agents. Should they fail to do so then you will hold them responsible along with their agents DR+.

You can't strictly do it but it might scare one of them into providing the information.

From the businesses you named I've found these email addresses for the CEOs :

KFC - martin.shuker@yum.com
Blockbusters - gary.warren@blockbuster.co.uk

And email the CEO of FarmFoods & point out their website store finder clearly says 'free shoppers parking'...and you were shoppers. COMPLAIN IN WRITING OR BY EMAIL.

Be proactive about these complaints and what happened when you contacted Innes England as I suggested before? Won't hurt to make a call to them and see if they still run this site - or were they only the selling agent as you 'found their details connected to the site online'... You lose nothing by it and even if they don't run the place maybe they'll refer your complaint to the landowner (THEY MUST KNOW WHO IT IS!) if you stay on the phone and make yourself a bit of a thorn in their side, say in a chatty way how frustrated you are and that your next step will be the local paper at this rate! Contact Peter Short, Innes England, Nottingham 0115 924 3243 according to this old sales info:

Plan B could be to ring up the Planning Dept of Erewash Borough Council and ask about this Planning Consent and who applied/who runs the retail park:

• I phoned Innes England, who said that they could not pass on their client's details due to data protection. They took my details and said they would pass them on to the landlord of the site - who in turn would contact me (which they haven't).

When I enquire, companies renting units on the site ask me to contact Smart Parking with queries. When I explain the situation - they say that they are unable to pass details on regarding the landlord (either don't know them or are unwilling to).

This was all previous to my last post. Yesterday I phoned Farmfoods again and insisted on speaking to the manager. He suggested speaking to their customer services department - which have apparently dealt with similar situations for customers before. The person I spoke to from customer services seemed helpful - and said that they had dealt with Parking Eye previously. He had never dealt with Smart Parking however. He took my details, said he would look into it and would get back to me.

I will give it till the weekend and if I've heard nothing from Farmfoods, I will fire off emails to each of the companies with units at the site (as you have kindly suggested).

Hopefully you'll get some joy from Farmfoods, although it is starting to smell to me a bit like a runaround.

Have you tried your local council, local authority or Valuation Office to see if they can help with identifying the landowner?

Quoting 'Data Protection' as a fob-off is getting as prevalent as 'elf'n'safety'!
