proving how much I make per hour/week on average is easy so proving loses incurred leading up to the case is just as easy.

This person who sent a letter could be anyone at all and they haven't stated anything that shows where the £350 charge came from.
I cant speak for photographer the OP ripped off, but if it were my image they would be invoiced for the same amount as I would charge for a 6 month image usage licence. And failure to pay would result in legal action to reclaim losses. All this and much much more would be explained in simple plain English so as to avoid any confusion on both the email and invoice.0 -

Is losing a client and possibly one who may be able to offer more contracts (bigger/better contracts?) in the future or one that may spread the word of how you suddenly pulled out of a contract really worth it to sue someone?
I know they've done wrong and all, but for the sake of one or two photos it seems daft to let them ruin your business.
No Im not willing to lose clients BUT neither am I willing to let people steal from me. taking someone to court is not something I like doing and would sooner sort it out before it gets to that point but sometimes there is no choice.
Thanks to forums such as this where incorrect/stupid advice is rife and offered up by the clueless.. people go away thinking their problems will all go away if they bury their head in the sand.. well it won't .. all you do is prolong the inevitable and make things a damn site messier and painful for both parties than it could have been.. and the really sad thing is you're all safe in your little virtual bubbles and never see to consequences of your meddling.0 -

You clearly are willing to lose clients or you wouldn't pull out of contracts.
Nobody here claimed to be a solicitor or anything. It's not like we're saying to ignore any legal documents either. We're also only going on what the OP has said and waiting for them to update us.
As far as we know there has been no word from the photographer which, at this point, suggests that they may not be that serious about following through with the legal stuff and were just hoping for £350.0 -

They have a point. I mean, even if it's more than an hour it's not a reason to pull out of a contract. It might mean putting more work into a shorter time period or having to reschedule or something, but it seems a bit extreme to just pull out of the contract. Your post did read as though going to court means if you have a contract, no matter what it is, you have to pull out of it.0 -

notification of a court date is usually at very short notice and although you may be told that the case will be heard on a Monday more often than not its a Wednesday or even the following week..
Unfortunately I cannot be in two places at one time so whilst every attempt will be made to reschedule a shoot its not always possible for the client to alter their schedule.. hence lost client..
as for the op updating you all... do you REALLY think that will happen?? they came, they failed to get the response they were looking for.. they left never to return.0
