If on JSA Income based it is 2 years max for SMI, but should you go down the IS route it is currently unlimited.0

I am not an expert but as far as I know you have these options.
1. You continue to claim Carer's allowance and work (not earning more than £100 a week.) Your OH is 'added' to your claim and you claim Income Support as a 'top up' but any of his earnings will be deducted from the Income Support. Benefits are that a claim for IS will mean you will continue to get SMI - downside is that his earnings may make you ineligible for IS (not sure of figures because you have housing costs)
2. You continue to claim CA and work. Your OH puts in a claim for Working Tax Credits to 'top up' his earnings. He only needs to work 16 hours a week because you claim CA. You won't get SMI but you may get more money this way.
As I said, this is complicated so I hope Epitome is around soon and can help (plus tell me off if I am wrong!)
In both scenarios you can claim Council Tax support.
yes we do allready claim council tax benefit.
Assuming when working out what we get with a complete year on WTC/CTC/IS i need to deduct the CA (£59 a week / £3,068 a yr) as its classed as income?...
1) IS (inc the disabled element): could get us £156 a week / £8,112 a yr. With no working hours limit but what can we earn?? (remembering I claim CA) and we'd also get SMI £135 a week (1.6% on 190,000 mortgage) We would still get full CTC at £171 a week??
2) WTC: 2 children (1 being disabled) we'd get £186 a week / £9,672 a yr. If we then earn over £3,352 it would then be reduced to £171 a week / £8,996 and so on...
trying to work out the pro's & con's (or maybe its best to do IS for a while then once salary goes up then switch to WTC, and so on until hopefully eventually we're back as we were before on NO benefits!)
Have I worked this out correct??0 -

Think you are getting some figures wrong here...
On Income Support you would not get the disability premium if you or your husband doesnt have DLA,
I think I read it correctly that its your child who gets the DLA and you get Carers Allowance for looking after that child..
You are able to claim I.S as you have C.A
But you can only earn £20 then your earning will get taken into account pound for pound against your I.S
Also you would have to declare your husbands self employment to them, they would require his accounts to determine how much he earns to take into account as well, he has a disregard of £5 against the I.S, this figure would be after expenses etc etc....
A SDM would look at this..
You would get the SMI.
You would just get the couple rate I.S, Carers Premium, then minus your Carers Allowance, and both your earnings after the disregards..
But of course you would get full CTC0 -

My total profit is zero at the moment and my husbands is zero with the odd occasional work? we had SMI for a few weeks but our benefit has now stopped temporarily as my husband signed off JSA after a weeks work, but they never signed him back on correctly - so mix up with payments.0 -
Then Apply for I.S if you want, as long as your husband is not doing more then 24 hrs a week S/E..
You will have to declare your work as well. if you are earning nothing then nothing will be taken into account but they will ask for accounts, nothing to worry about you can do these your self, out going expenses etc..
As said when you start earning then you will have a £20 disregard and your husband £5....
Your smi will link so would kick in straight away.0 -
Your husband can't claim IS, but he could stay on JSA (IB) (and will have to close the claim if he works 16+ hours in any week or you work 24+ hours) household income will be declared and deducted.
Only you can claim IS when his JSA (IB) is closed..... you will have to close the IS claim if you work 16+ hours or he works 24+ hours in any week. Household income will be declared and deducted from IS. On IS you won't get the disability premiums because neither you nor you husband get "DLA care/PIP"
Whether it's JSA IB or IS it would be 112.55 + 33.30carers premium minus the carers allowance so total = £86.10 (less the household income - but there will be some disregards to income as mikey bach has pointed out.)
I don't advise on WTC so I have to assume pmlindyloo has got that option correct. Thanks for the compliment, but on this one, that's all I can give.0 -

Thanks for helping.
My Husband has now gone on to the New Enterprise allowance if that changes any of our entitlements? (no longer IbJSA)
I was under the impression hours worked are not counted if you also claim carers allowance?
With carers allowance I thought one could earn up to £100 without it effecting benefit. Is that not allowed with income support?...im just thinking ahead if/when I start to earn a little0 -

For income related benefits such as IS there is a small disregard then everything else is deducted £ for £
I believe for couples this is £10 per week so and income of £90 in a week would reduce IS by £80..not sure if they count the NEA as income or if indeed you can claim IS and NEA at the same time0
