I was thinking of ways to fit that pun in...
I think that at huge pop star at the climax of the "Haydork Park Music Nights" is not just a race night.
I guess the only way it could be settled would be in court, but I dount it would get that far.
My worry is a term that says if you book the music race night and the music part is cancelled then we will issue a partial refund for the music part sounds more than reasonable. It doesn't seem unfair.
If you look on twitter a few people conplained about this policy and they basically said tough!0 -
I've just read the advert linked to in post#7 and it seems pretty clear to me that not only is the music a significant part of the event, it is the major part of the event.
The ad title is:Rita Ora to Climax Haydock Park Music NightsNo mention of racing there.
In fact, that webpage hardly mentions horse racing at all.
It really does appear to me that the event is a music night which just happens to have some horseracing beforehand.
OP, on that basis, I believe you are entitled to a full refund.
It would be a good idea to keep a copy of that webpage if you are thinking of taking things further.0 -
Problem with that argument is there is more to the advertising than just one news story. The links take you to the racing website where the whole details of what you are booking are explained. Therefore it doesn't really matter that this one news story is mainly concentrated on the musical aspect.0

Thanks for your input everyone.
It does seem the only way to find out who is right would be to go to court, but obviously that approach could end up costing me money if I were to lose, which I suppose is what these big companies rely on! Personally, given the ads surrounding the event I think I would be in with a good chance but its a theory I can't afford to test!
I have written a letter so will update with what happens, if anything.0 -
I work a lot on racecourses and unfortunately they tend to have very robust refund policies. I would be very surprised if you had any chance of getting back any more than they have already offered.0

Doesn't mean it's right though, they can have whatever refund policies and terms and conditions they like, but if they don't comply with statutory law, they are null and void.
But like I said it would take somebody to challenge their policies in court, which very few are willing/can afford to do, which is what they rely on.0
