Moving to another council area, applying for temp accommodation

Oops, forgot I had asked this. I do have a HO, they did say you can get a referral so maybe I should try this, I guess that would best way, I am assuming a referral will give me a definate answer while I stay here in temp acc?0 -

Maybe. It could give you a local connection. But, as your homeless application has beeen dealt with by another authority, they must ALSO deem you to have a local connection.
Assuming the main homeless duty has been accepted:
The only option you have is for your current homeless accept to be transferred to the authority where you now wish to live. They, of course, might choose not to accept such a referral.
If you lose your temporary accommodation as a result of your own actions (ie surrendering it), you may be found to have made yourself "intentionally homeless".
If your homeless application is still being investigated:
You may withdraw the application and apply again in your area of choice.
That area would also have a duty to provide you with temp accommodation.0 -
You can't be considered intentionally homeless if you give up temporary accommodation.
You can ask the local authority you currently have your homeless application with to refer you to the other area but unless you have a local connection - family there or a permanent job there or have lived there for 6 months out of the last year or 3 yrs out of the last 5 then it is extremely unlikely they will accept you.
If you close down your present application and apply in the new area they'll just find you have no local connection and say you have to go back to the area you do have a connection.
And also, as above, 'vulnerability' or priority categories no longer exist under Scottish homeless legislation - there is a duty to everyone who is accepted as homeless - provided they are not intentionally homeless and have a local connection (which is your problem)
Why not try and hang on where you are till you get a permanent house and then try to get an exchange with someone in the other area. At least you would have a house of your own in the meantime.
But no harm in asking for a referral just now, you would stay on in your present temp accom till the other authority said yes or no and if they say no then you still have the homeless application with your present area.0 -
P.S. It being your birthplace doesn't count unless you pass one of the local connection rules above0
