We put a deposit on a second hand car we couldn't take it then as the dealer didn't have the log book ,he said he was sending away for it, this was the 16 august
we have received the log book today by post which is now in our name from the 16th of august even though we wasnt in procession of the car? are we liable for the Tax?

    What tax?

    Are you thinking about Vehicle Excise Duty?

    Or the late licensing penalty for not declaring SORN or paying the VED on your car? You can SORN your car now..You have some time from the date you buy the car to SORN it....so a few days yet...I'd do it today online. Then wait until the 1st September and pay for the VED and save yourself some money. It'll be backdated to the first of the month in which you pay for it. So if you aren't desperate for the car I'd wait till Monday.

    Yes, from the date that ownership transferred to you.
    Just buy it (the taxdisc) today, and you will get it from 1st august so you will be covered.

    The DVLA make up their own laws, and the hassle that you will get if you try to tax it from 1st Sept and miss out August is disproportionate to the money that you save.

    If it is insured, just go to the online site and bash in the number it asks for off the front of the V5 and pay by visa card.

    Unless it is taxed, or the dealer has taxed it for you already....
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    Don't give the DVLA an inch, what they do, if not for the govt being behind them, would be criminal. They'll issue a fine and whatever "excuse" you make, they'll change what the fine is for until they find something you can't get out of. They usually lose if they take it to court, but in the meantime you'll be dealing with threatening letters and debt collectors on your doorstep.

    The best way is to pay up and then make it your mission to warn other people. If you warn 10 people, then for the £80 fine you paid, they'll have lost out on £800.

    I think what really gets my back up is they way they sell our details to 3rd parties, don't chase after people who are too hard to trace (people using false names/details) and they concentrate purely on milking money from the law abiding general public.

    Thanks I suppose I expected the dealer to get the log book, then we get it from him when we paid for the car

    And don't even think of phoning the DVLA, you are forced to listen to lengthy diatribes before the options come up and at each stage of the options tree, then 99% of the options dead end at a recorded message and hang up.

    Took me over an hour last time I phoned (because I hadn't had a red V5) to get a person on the phone. The number of times I heard out of date recorded messages would beggar belief if you are not used to "efficiency"
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    Phone the dealer now and sort it out, you need insurance on the car in your name to tax it.

    Don't listen to "it will be al-right" it won't.

    You may find they still come after you for no insurance, get a timed & dated reciept that says exactly when you took over ownership of the car and match that to the insurance start date. (They won't pre-date a policy)

    And to complicate things still further, if your not part-exing your old car, you'll need to either take the new one off road, declare SORN and keeping using your old car until you sell it OR take out two insurance policies OR declare SORN on the old car and try to sell it without any tax, this to make sure you don't fall foul of the DVLAs "continuous insurance" enforcement, where you must have insurance or declare SORN.

    Got to be really careful these days......

    Thanks, my husband will ring the dealer later, then we will sorn our old car and keep it on the drive till its sold

    So you paid a deposit on 16th August for the dealer to hold the car - the dealer didnt have a full V5 and assuming you didnt sign a V62 form?

    On the 29th August you received the V5 in your name and not collected the car?

    Think you need to check that the V5 is not a fake before paying any money to the dealer.

    If you SORN your old car then i'm assuming you are not allowing people to test drive it?
