Off-plan not built to advertised plan

    The response we have received:

    "You cannot gain access as it is still under construction yours in a row of three this is why it is different so there is no window in the bathroom and you loose a window in one of the bedrooms it is best to book you in during the week and I can arrange for the site manager to take you in due to health and safety they have to assist you plus any questions you have he will be able to answer. Sometimes when you buy off plan then look at a show house you automatically think it is the same but our literature does state that it does not bind or imply that the layout will be as indicated and as I mentioned to you this is when I book you in to do the plot schedule. Hopefully we can resolve this and you will be happy what you are purchasing but I will need to know ASAP because I will have to cancel the kitchen with it being an upgrade and the extra unit you ordered if you are wanting to cancel I will need to know by Monday can you get to site on the Monday? There is no other day as plasters are here Tuesday and there are no children allowed on construction site too please could you let me know if you are to attend the best time is morning from 10 onwards

    We've asked for access to the house to see how bright it is inside. Three points about the response. Her suggestion that because it is in a bank of 3 is rubbish all the other banks of three have windows on 3 sides. - Just ours, she clearly has no idea about what she is selling.

    Her suggestion about needing to know by Monday stinks to me, they should be accommodating us under the circumstances not forcing a decision/response.

    Plus her response about loosing a window in the bedroom and bathroom is worrying. She does not mention about losing them in the living and kitchen. Does this mean we have windows looking into the neighbours alleyway? Or is this just another mistake she has made.
  • Her response is very poor and quite unprofessional.

    Rubbish sentence structure, loosing rather than losing... jeez, I'd not be particularly impressed with them at all.

    I'd point out all this to the site manager when you go and see him, this seems like an office bod that doesn't really care either way.

    It doesn't sound like they give a hoot about your concerns or whether you buy the property or not.

    The loosing was me, but then I suppose I'm not required to be professional in my response! But you should see some of her other emails if you think that is bad.

    It looks like we are being forced to pull out but moving on is another thing. Without going into details we are really not happy where we are now.

    They don't do a detached version of the house so what you have said makes no sense. I suggest you read the rest of the thread. But to summarise all the Loxleys have windows on 3 sides, all the Loxleys are end-terraced with another house in-between.
  • Am I right in guessing that the plot number is between 45-49?
    If so, are you saying that the other Loxelys among those plot numbers have the windows in question and only your plot doesn't?

    I was looking at the site plan on the planning permission website and comparing the different Loxley plots.

    Loxleys between 45-49 overlook the neighbouring property on side (windows in line with the neighbours windows, close proximity - so can be a privacy issue).

    One the other hand - 40,42, 51, 54 - are different (51's side faces the road, 40's side faces the garages, 42 & 54 the back gardens). These may be the ones with side windows.


    Or .... it can be the other way round all together!

    Just thinking aloud!
